VW Approved Used - Dealer cancelling order
Discussion
Bit of a long one, I'll try to keep it brief.
Yesterday I contacted a VW Dealer (Robinsons Norwich) via phone. Over the course of a few phone calls we did the following:
Received a written quote for a car purchase and finance including trading in my current car
Paid a £99 reservation fee
Received and e-signed finance documents from VWFS
Received a phone call from the dealership to arrange collection in a couple of days time
Today I've had a phone call telling me there's been a mix up and they had already sold the car to someone else before I reserved it. The message is "you can buy another (more expensive) car or tough titties".
So the way I look at it I'm at a loss for the following:
• Lost time spent on the phone/email
• £99 paid in a deposit which has been debited from my card
• A hard credit check on my credit report
• Being sold and signing a financial agreement for a vehicle which they knew was not available for sale at the time they sent the agreement.
• Time and cost valeting the trade-in vehicle ready for trade-in
• Swapping insurance from one vehicle to another unnecessarily
Has anyone heard of this happening before? At a bare minimum I want written confirmation the VW Finance contract is void and the direct debit has been cancelled. The young lad on the phone couldn't do much and refused to let me speak to the sales manager, instead he's given me the sales managers email address and VW complaints details.
I imagine there's small print that means I'm not legally entitled to continue with the purchase, but surely if VW offer a £99 reservation fee that should give some kind of guarantee your car has been held for you.
I'm fuming!

Happened to a colleague on a new BMW. As mentioned above, he said he'd taken legal advice and pointed out to them that a contract was in place and that money (the deposit) had changed hands. They ordered him the same car and put another £1000 into what was already a pretty stunning deal.I guess it's a bit more tricky as the car you were buying isn't new.
Isn't the VW used finance at a horribly high rate? You should be able to do a lot better. Or did you place to Withdraw from it?

Planning to withdraw to be honest, it had a lot of perks such as 2 year warranty and 2 services which would've offset the cost of interest anyway.I guess it's a bit more tricky as the car you were buying isn't new.

What do these documents say regarding their right to cancel the agreement ?
Unfortunately I'm struggling to access them - I'll try to get a copy. It was done online via VWFS. I have the agreement number but cannot access the account online yet.I'm a bit annoyed as I had the opportunity to download them as PDF after signing them but opted not to because I assumed they'd always be available online!
Don't waste time fretting over the finance documents.
From what you are saying it's the dealer who has cancelled your order not the finance company. Until the finance company receives an invoice from the dealer and pays it you don't actually have an agreement with the finance company.
The cancellation terms that you are looking for will be on the dealer order form that you signed.

Thank you, that sounds similar to what the dealer was telling me on the phone only you've phrased it much better and more succinctly. From what you are saying it's the dealer who has cancelled your order not the finance company. I'm hoping they may be able to do something out of goodwill given the inconvenience and costs incurred at something that was so easily avoidable but I won't hold my breath.
Now they are open go in and see them take everything with you and sit down with the sales manager and see what they can do for you. If you still want a car, they will be able to trade cars across all the VW dealers stock, so push for a good deal etc....
If you're polite but firm I can't see them not wanting to see you happy and sell another car.
