The reason it was difficult to bring him to trial previously was because the authorities knew he wasn't present at the murder and 'burial' scenes.

He was finally convicted of instigating the three murders.

It was allowing the 3,000 page transcripts from the 1967 federal civil rights trial that led to his conviction, this time. I think he also confessed to being a member of the Ku Klux Klan, and possibly someone testified to that.

I would assume that there has been a court battle to get the transcripts allowed as evidence.

Don't quote me on this but it's the best summation I can come up with after reading 8 or so news articles on the trial. Most of them mentioned the case being delayed for the defense to go over new evidence but didn't mention what the new evidence was.
