S1 seat issue, could I fail MOT?

So there is a leaver that adjusts the seat up and down. Works perfectly fine going up, as my head touches the sunroof, however down it seems to have broken..

Car goes in for MOT Monday, still under warranty, however Audi cannot see it for another 3 weeks for repairs.. Will it fail it's MOT? Seat will recline and go backwards and forwards..

As long as the seat is secure and the backrest remains in the upright position, it'll be fine.
