Hi guys
Recently bought a car online from an autotrader trade seller and agreed to have it delivered by the seller .big mistake, before agreeing to the sale checked all The mot history /hpi checks and the seller seemed genuine and honest so trusted him but when it turned up with a delivery company on Thursday it soon became apparent that this car was not in the condition as described .the bodywork much more scruffy than expected and been badly touched up so would require around £500 to fix this and there was supposed to be service history with the car but got absolutely nothing but a very basic handwritten recite for £50 of parts from 5 years ago .It also seemed strange aswell that the seller had only gave me section ten of the v5 and presumably he had already signed it on my behalf for some reason even though never asked for this
He also said that there would be a 3 month warranty but no written proof of this but assures me it’s been done online but not convinced but have got this on an email

I have politely asked for partial refund of £400 but he wasn’t having any of it and he turned a bit defensive about the complaints
I am getting a full mechanics report on the car on Wednesday as I know very little about the history
Apparently the cam belt could do with being done due to the age as it was last done in 2013
There is one plus side that It seemed ok on test drive
But I am wondering if I end up keeping this car I’m likely to be selling it on in a year and not many people will buy any car with no service history?

Seeing as the purchase was online won’t you be entitled to cancel and return the car for a full refund (assuming you’re still within 14 days of the purchase date?) as per EU law.

If the car was sold with FSH then I'd be asking for more than the £400 back.

Hi yes the original description says service history.and not worded like full service but there is literally no paperwork and unfair to say Service history
As soon as I have the garage report I can get an idea what else he didn’t tell me
Or just send it right back as I paid top money for the model

Is he a trader? Did he advise you of your right to 14 day cancellation?

If you paid by debit or credit card, you have some good options.

I’d suggest you write to the dealer, request either a sizeable refund or a full refund, and list the reasons why the goods are not as described.

If they say no, or ignore you, you can contact your bank.

Debit cards allow Chargeback, where you can prove the goods are not as described. This is where the bank effectively reverse your payment and claw your money back.

Credit card purchases come with something called Section 75 protection. Again, you can request your bank investigate this matter and refund your money.

It’s much simpler if it was a credit card for various bank related reasons.

If you paid by a bank transfer, you’ll need to go down the distance selling regulations where you’re entitled to a refund within 14 days of delivery. If the dealer doesn’t play ball, you’d need to involve the small claims court to get your money back.

With respect £400 back on a car at that price doesn't seem unreasonable, however as has been said I think you are protected by distance selling/credit or debit card rules

Still unsure what I plan on doing with the car but seen some nice brand new t6 transporter 16’’ alloys am I right in thinking these would fit the golf
