It’s important to note that this isn’t the court judging that the use of facial recognition in itself is unlawful, just that the testing and assessment of it hasn’t been robust enough.

They need to thoroughly investigate whether it discriminates against any particular groups of people (which in other systems it has been found to), and create a proper privacy impact assessment for it.

In my view it’s good news that, as the article says, the brakes have been squeezed a little, and that proper assessment of it must be done; but I very much doubt this will do anything more than delay the use of the technology in future. It’s far from being the end of its use.

A friend worked in Hong Kong/China and has friends there, British Citizens and HK/Chinese. All communications with them have become very guarded in what is said. There is a lot of fear. One thing that has come across is that the Chinese are planning to expand facial recognition camera use as a means of watching people. I don’t know how accurate that is but it wouldn’t surprise me.

I live in China, new cameras going up everywhere, I am sitting outside a restaurant beside a lake having a beer, I can see six cameras pointing in my direction. It's difficult to not be in range of a camera anywhere built up.
