Want to return an opened item to Argos. They say no.

Ok, its a cheap Android tablet. It just isn't good enough for our needs, our fault, but we weren't to know until we'd tried it. It was bought over the net, from Argos, delivered today.

Can we insist they take it back, or are they within their rights to say no, as it has been opened and used for an hour? Distance selling rules no longer apply?

It's not that important, as it was 'only' £60.

Did they give a reason for not allowing the return? You should be allowed to return it but it sounds like they might be trying to class the tablet as "recordings and software that have been unsealed" which would mean its not covered under the cancellation rights under the Consumer Contracts Regulations Act (formerly Distance Selling Regs)

I don't know the rules, however this is exactly the reason 'normal' shops struggle against Amazon. They need to wake up while they still have the chance.

I ordered an expensive handheld vacuum last week. Initial impressions are it's crap. I'm giving it one more chance - to do a decent job of hoovering the car when I get back from a week away - and if it doesn't do the job, I'll be sending out back to Amazon. Unpacked and used several times over 2 weeks and then sent back for a refund because it's not good enough for my needs.

Did you do anything with it that they wouldnt let you do with a display model, for example download an app or sign in?

If so they do have an excuse under distance selling and with good reason, they cant easily verify its condition before reboxing.

You can return it within 14 days however if it has been used beyond what would be expected in the store i.e. you have actually used it, they can deduct an amount from your refund, upto 100% of the cost if appropriate.

A £60 tablet was always going to be st. Amazon would have been more forgiving on the returns but in this case, Argos are right I think.

For the potential hassle, I think I’ll just keep it. If I can (eventually) to get it to stream Qobuz at hi res and gapless to my Yamaha streaming pre amp, I’ll be happy enough.
As an Apple only user, Android is, erm, a challenge!

I've heard a few people using similar experiences to justify their love for Apple products. It's a common theme...buy cheapest Android product on market, try for 5 minutes whilst refusing to look up any Android commands/menus that are unfamiliar, discard and announce that "Android is ste".

Nope, you definitely didn't buy a cheap android tablet, compare it against an expensive apple product and then announce android to be rubbish. That didn't happen.

OP - stick with Qobuz on your iPhone, CD quality is enough and if you're not convinced, have a read.....

Distance selling regulations apply and you just say you want to return it. No reason needed. Opened or unopened.

I've order phones from Voda and as I'm ordering over net (ie distance) I know I have 14 days to return even if I've used them, downloaded my contacts and installed apps.
The only proviso being the item remains in resalable condition.

A tip from when I worked in the tech section of an old big name computer store. If you want to return an electrical Item such as this, stick it in the microwave for 5 sections. You’ll find it won’t switch on anymore with no visible damage.
