Having read brief details of this i assumed my phone diary had malfunctioned and the date was early in April...
How in gods name did this proceed beyond someone telling her at the station to f
k right off?..
At what point did some solicitor go....actually yeah come to think of it i think you have a good case let’s take this to the judge...FFS ...High Court?.,that’s that serious place where they decide important matters of law right?..
Why didn’t someone at some point gently take the lady..and i use that word strictly in the biological sense ...aside and say..you got pissed threw up and were lucky someone with a sense of decency adopted a duty of care and helped you out...NOW fk OFF...
My son who has just started a training contract as a trainee solicitor in London is wondering what he has let himself in for...

Being a litigation lawyer is very bad for the soul, but it does bring with it a rich store of anecdotes.
This case should of course never have been started, but (1) even the worst people have the right to go to court, and (2) there are some lawyers who will argue any point.
The lawyers for the idiot very probably told her that she would lose, but she instructed them to press on. If a lawyer is instructed to to something, then as long as doing that thing is not illegal or contrary to the rules of professional ethics, the lawyer has to press on.
This case should of course never have been started, but (1) even the worst people have the right to go to court, and (2) there are some lawyers who will argue any point.

Witty judicial prose was once commonplace but is now a rarity. Judicial writing used to be terse and elegant, but has become less so in recent decades. Mr Justice Turner is one of those Judges who still cares about writing.

I strongly doubt that legal aid funded this. Civil legal aid is almost defunct, and even in its hey day a merits test was applied before funding. Breadvan72 said:

Health and safety in this country is governed by laws and by codes of practice. As a union safety rep I was taught that while a COP is not a law, it can be brought up in court, and decisions can be based on adherence (or not) to what it contains. So, Mr Manager, stop trying to be clever and obey the advice it contains.
It seems that if the law is a but squiffy, or is made to look so by an idiot, as in this case, as in health and safety, then the COP is the right way to sort it out.

During the course of oral argument, Mr Gow on behalf of the claimant made several good-humoured attempts to smuggle into the appeal a number of points which had either not made below or had not been included in his grounds of appeal or skeleton argument. Take that, Mr Gow. I wonder if the judge is an A.P. Herbert fan.All good Judges are A P Herbert fans. Judges also used to be able to quote Shakespeare, Virgil, Alice, and Gilbert and Sullivan at will. But alas those days are passing. A generation of careful and plodding barristers has produced a generation of careful and plodding Judges. A few, such as Mr Justice Turner, stand out as being like Judges ought to be.
