I am new to this forum and could do with a bit of advice on the situation. Always bought my cars through PCP and this was first PCH deal.

I have a specific scenario around a car order that I cancelled on PCH via National Vehicle Solutions. I ordered a car in February which was a stock order (timescale 2/3 weeks for delivery), Audi Q5 S Line Plus which was due to be delivered on 31st March 2020, due to Covid there was a delay and did not hear from the leasing company until end of April, due to changing economic circumstances plus we were still in lockdown at that time I was reluctant to have a new car sitting on the driveway not going anywhere. Plus we needed a car at the end of March so I purchased another one at that time from a family member as NVS failed to deliver when they said they would.

To confirm:

1) I have signed and paid for the order (£240 admin fee) and I am months past the cooling off period of 14 days
2) Did not receive the car and signed completed financial paperwork with the finance company

National Vehicle Solutions are threatening me with legal / court action if I don't pay £500 cancellation fee which is set out within their terms and conditions of the order form we signed, please see below. I am waiting for the Financial Ombudsman Service to investigate my complaint against them.

In the event of me/us canceling this order for any reason, other than stated or failing to take delivery within the specified period I/We shall be liable to pay a cancellation fee of £ 500.00 to “National Vehicle Solutions ". In the event of non-payment, you will then become liable for interest and debt collection costs which will be added to the cancellation fee.

My question is am I liable for the £500 cancellation fee as they failed to deliver the vehicle within the specified period?
