Anyone know any more on the backstory/details of this. Is this another case similar to the Ghurka's being denied residency?

Whatever people might think of the opinion pieces in The Guardian the reporting is usually pretty decent.

Priti Patel is my guess.

You (not necessarily you personally) voted for it and you've got it.

Fight for the country but can't stay. You can die for us but not with us. Disgrace.

Doubtful as this appears to have been going on for years.

I'd imagine it could be fixed pretty quickly if the will was there.

Possibly, but we don't know the full story, which is why I asked.

On the face of it it does seem stty and morally the guys should be allowed stay but I have a feeling there will be more to this than is reported in the Guardian article.

Google doesn't turn up much.

Like I said where there's a will there's usually a way.

...ultimately they will stay, for sure, I just have a feeling there is more to it otherwise the Govt would not seek to court such negative publicity through choice - it will be a legal thing

I remember the Ghurka pensions and residence scandal. Everyone signs on the dotted line giving a blank cheque up to and including dying for us. They all bleed the same colour, there should be no difference in their treatment. Sign on and complete your service then you get all the benefits that we take for granted in this country. If that means families moving over here then we should be welcoming them

If the government don't act, and act very quickly I hope the country comes together in this Remembrance season and petitions for this inequality to end.

Except you clearly can stay, if you follow the process that, for whatever reason, it appears they failed to do. I can't believe, at the very least, that the fees aren't waived for those who served in the Armed forces. Given the judge's comments it looks like they don't have a leg to stand on going this route. The government needs to step in and grant them right to remain by some other process, and quickly.

ETA another article on the process... looks pretty miserable. Should be free and automatic IMO... at least 500 a year do it though so it's doable.

The government could and should act here - if they fight for us, they can stay - my simple view on it.

I hope so but these 8 appear to have applied incorrectly, outside the 2 year window, left the country or not paid the visa fee... either way the high court has said their legal challenge is incorrect and what they're asking for is not legal. Clearly the law does need changing but if they had followed the rules like all the others they'd probably all have been fine years ago. It never ceases to amaze me how st governments of all colours treat our armed forces.
