Hi,

We've received a speeding fine notification in the post. It tells us which day it was and at what time but we genuinely can't remember who was driving (we were driving/stopping a lot and kept swapping).

What should we do about putting down who was driving? It, apparently, was one of those cameras that sit in a van at the side of the road - pointing through a small window (if you know what I mean!!).

Can we ask to see if there's a picture to show who was driving (it shouldn't be too hard to tell - I'm a lot bigger than my wife!! ;)) or does this type of camera not take pictures, just scans number plates/whatever?

Check Pepipoo for examples but I'd do the following in your situation....

When you receive the NIP for the alleged offence, don't fill in form but write back saying it could have been yourself or your wife driving and explaining you don't keep a written log of who drives at any particular time. Politely say you are doing everything in your power to exercise due diligence as required on the NIP and request photographs.

Wait for the photos to arrive - if you cannot identify the driver then write back stating that you still can't identify them.

It will then be up for the partnership to decide whether the matter will be proceeded with under Section 172 of RTA 1988, for failing to furnish the Police with driver information. However keep a copy of all correspondance to prove that you have acted with due diligence.

If you can identify the driver from the photograph then there are various ways forward on Pepipoo.

Remember they have 6 months after the date of the alleged offence to file papers at the court or the charge must be dropped.

If it was a scamera van don't forget to request the police number of the serving officer who formed the opinion of excessive speed prior to the speed measurement device being used.

I think what Kevin is alluding to is the shocking idea that the camera operator might not actually be a trained traffic officer.

Yep, Some Scamera pratnerships do use civilian operators and in these cases if the case is taken on to court and you request the details of the Police officer they do not proceed. This is down to the requirement for a Police officer to "believe" you are travelling above the limit before a device can be used to confirm it. A civilian operator doesn't fall into this category and no Scam unti has been willing to continue in case a precedant is set and previous NIP's that drivers have recieved would be revoked.

What about asking them who was driving? After all, it's their accusation.
