Hi guys,

A mate of mine (no, really, I haven't built my Ultima GTR yet!) has recently been done for speeding twice within 20 minutes on the same stretch of road - by the same mobile camera.

Apparently, he has been sent two separate NIPs offering 3 points and £60 fine (arriving by post on the same day).

He has 6 points already on his licence. 6 plus 6 = 12 ie, which I presume is a ban because of totting up.

QUESTIONS:

1) He was just a little over the 25mph limit for one of his offences, so why was he offered 3 points and a 60 GBP fine? Is it 30mph for some forces?

2) Are totting up bans harsher or less harsh than 'all in one hit' bans?

3) As he was done twice in such a short period of time can he be let off one lot of points - IIRC other offences can be taken into consideration and then the sentences run concurrently elsewhere in the legal system.

4) Is it worth asking about laser/mobile camera calibration re loopholes?

5) Could a granny or student have been driving at the time of one of the points... what is the law's view on this (attempting to pervert the course of justice?) and has anyone been caught doing this?

6) Or should he just take it on his lantern jaw and get a good lawyer to keep the ban as minimal as possible?

7) Does anyone know any good motoring lawyers?

from my experience Totting is worse than Rape or Murder in the eyes of some magistrates.
When I got done 101 on an empty dual carriageway, I alrady had 6 points. I argued and pleased for 5 points and a larger fine than the 6 points and a totting ban they were going to give me. suffice to say, Ive had a clean license for the last 6 years until a bloosy scamera had me 2 months ago

So did they give you the ban, or did you get off with 11? I suppose it's best to get a short ban and start from 'nul points' again.

Sounds like the best result given the circumstances.

Anyone know how long a totting ban is likely to be?

discretionary area to an extent. As you say other forces might have gone straight to court..

definitely - will very likely get a 6 monther for totting IIRC.

YES! As it was impossible for him to know of his first offence by the time he committed the second then both **should** be treated as a single offence. My mum had someone in court who managed to get scammerered 12 times in one journey once!!

yes they could have been driving...but... The law DO see it as perverting the course of justice (wonder why that could be!) and yes, someone got caught recently. It's fair to say the courts might not like speeders but they f**king loathe people taking the p*ss out of them! Your mate might find himself keeping bubba warm at nights if they're partiocularly vindictive.

should be okay with the 'two offences as one' issue to be honest.

my opinion as that they're an utter waste of monye. Popele who can afford lawyers can afford big fines....and it isn't exactly complex ligislation you're dealing with. I reckon that for minor stuff lawyers can do more harm than good....)

Thanks night for some sound advice. Long time no hear and all. Hope the international pharma world and associated swiss totty is treating you well I presume you're still driving something with a bull badge on it?

Will let my mate know about two-for-one. Do you think it's fine representing yourself, or is it worth getting a solicitor in who knows the relevant case law etc.?

Hi mate,

Yeah - been out the UK a lot again - pain in the butt frankly! Car...mostly driving something with a (cracked) Chapman badge on the front - Lambo out in Italy and sadly about to be sold. They're taking too long releasing the Gallardo SV!!!

re: representation. Magiatrates arent prosecution barristers. They dont tend to try and pick stories apart, or make you trip over yourself or anything. I'm not really sure how a defence lawyer can help in a case like this, and i know it can get magistrates backs up ("Im rich and can get out of anything"....i can try and find the treating offences as one thing if you like in the magistrates handbook?

Ja - but there ist little matter of disclosing even short ban to insurance company who do not like this und load the premium as they

1. like the extra income

und

2. think person should be taught lesson for another five years or however long they expect a ban declarable - und base this on the points disclosure business und questions on my policy ....

As for defence lawyer - advice would be worthwhile as they will be able to tailor the grove... but I would try the pepipooos site, Liebchen...

How come you haven't crashed your car for driving so fast so frequently
