Yep paying this way is known as "rolled up" holiday pay and is unlawful.
In practice, it's still widely used, particularly for short term casual work.
Provided you have adequate time off work to rest and the payslip is clear about what constitutes wages and what amounts to holiday (and it marries up with the rate agreed in the contract), there shouldn't really be an issue.

Spoke to the agency again to advise about holiday pay, and that other agencies are now getting more pay than me, same job, as well as been there for 10 weeks and what will happen after 12 weeks when i get compatible pat to a full timer, the agency had no clue. Very frustrating as i just want what is legal entitled.
