Drunk named driver wrote 30K car off
Discussion
so basically my mates been an idiot!
Its not something he normally does but its happened now and he's got away without hurting himself or anyone else. (luckily)
He was driving home after a funeral and piled his Mrs car up, he went into someone's fence. He called the cops him self, but he was over the limit.
Tesco are not going to be paying out even though it was not his car or his policy, I'd fully understand if it was his car and his insurance but the car belonged to his partner and it was her insurance policy.
When he took the car he was fully insured and sober. Surely its not the owners fault what he did she had no say in what happened but she has just lost a 30K car
Is this normal?

Looks like she’s suing him then. Its not something he normally does but its happened now and he's got away without hurting himself or anyone else. (luckily)

Presumably he was a named driver on her insurance?
How could he have been sober when he took the car but over the limit when he crashed?
That sounds like he really was drinking whilst driving.
He did have her permission to take the car or was she with him at the time?

From reading the policy booklet looks like they won't be getting paid out on the car and hopefully the fence isn't too expensive to repair either

I think it is quite normal, yes. AIUI with some insurers, cover effectively becomes 3rd party only if you're drunk.
It's not normal, but yes, it's a condition with many of the cheaper crappier policies like Admiral Group etc. It's an awful condition to impose on a policy, especially when it applies to additional drivers. Most decent policies with proper insurers like Aviva etc will only impose this restriction if you've disclosed a previous drink drive offence when applying for the insurance.

Christ, so there's no cover whatsoever, not even third party. No wonder these policies are dirt cheap. Section 11 - https://www.tescobank.com/assets/tesco-car-insuran...

Why just drink and drugs, surely any illegal activity should be on the list? Crash whilst speeding over the limit, no cover. All are choices the driver makes.
Would there be a "downside to that? Obviously there is if you've been a dick and have to claim but OTOH if you drive like the famous Miss Daisy you'd get cheaper insurance?

but the principle of "Obey the law = cheaper insurance" sounds good to me (in principle). My Son also did this foolish thing and his insurer paid out for the 3rd party, i.e. they'll fix the fence as they have a legal obligation to cover it.
They wouldn't pay out for his car, which was a £750 Skoda, so no big loss..... but they DID come back later and try and sue him for the what they paid out on the house he hit, which was 23k. The house owner understandably took the opportunity to have a BIG revamp, replacing everything within eyesight of the crash....
They came round and interviewed him to see if they could get away with suing him. When they realised he had zero assets they sent him a letter to say that's the end of it and to not use them ever again.
Your mate, will be paying for the car (was it on lease / pcp)
and will be chased for the fence. Which will be done to the most expensive standard possible. His misses will need to sue him to get anything
back!
If it's a lease / hp / or pcp, that car will need to paid for!

It's entirely up to the insurer what they offer to cover.I don't drink and drive so the current restrictions wouldn't bother me. I wouldn't buy a policy that had a speed limit get out though, and I suspect many others wouldn't.
They wouldn't have a insurance business after a while.
