Travelling in loading areas of vans

I'm probably just being stupid asking google the wrong questions but I'm struggling to pin down specific laws/rules regarding adults travelling in the loading areas of van.
This popped into my head around hearing weird thinking around sharing transport in these covid times
Scenario being adults sitting on wheel arches/tool boxes .etc. No actual built for purpose seating fitted.
Are there specific offences being committed? Who's on the hook - driver/passenger(s)/both?
At the very least, if something goes wrong I expect there some legal and insurance implications.

If dealt with by way of fixed penalty it's 3 points and £100 penalty. If dealt with through the court system it's 3 points or a discretionary ban, fine could be up to £2500 in court. If it is a second offence within 3 years it a mandatory ban. CU50 endorsement code on your licence.

In my teens I was a pheasent beater for a few summers. Myself and the other dozen or so beaters were loaded into the back of a yellow Mercedes Sprinter with some loose hay bails to sit on. The doors would close and it would be pitch black and we'd get transported to the next drive 5-10 minutes away, where we'd be bundled out to go scare some birds
Back in my guitar hero days we used to chuck the gear in the van so it was as flat as possible, then a couple of piss stained double mattresses on top, then set off round Europe for months at a time, three in the front, and up to five in the back. Happy days.

We moved from London to the Shires back in the mid 60's . Me, dad, two brothers and a bull terrier in the back of the furniture truck with all of our worldly belongings. Kids didnt stay sat on the setee for long, had great fun running round in the back of the truck, chased by the dog, getting thrown all over the place as we drove round corners - happy days
Many years ago I used to hang out with a band who gigged frequently in venues all over the region. I looked after the tech stuff for them. Our "tour bus" was a van with leather sofa which we had on "long term loan" from a nightclub in the back. I recall one squeaky bum moment when we were going up a hill and the sofa slid back against the rear doors and almost opened them. Those were the days
