Hi all, I have a question regarding sick pay.
I was paid furlough when I tested positive for Covid-19 and was off ill for 3 weeks even though I am staff and usually get full pay when off sick.
Apparently the company can do this as I spent 10 weeks last year on furlough.
The question is this, will the company be able to claim my 3 weeks off as absence?
The reason I ask is that I had to do a return to work interview, and when I asked why as I was on furlough my manager got uptight and would not answer the question.
Those who have to deal with the Bradford factor will understand my concern.

When you say "paid furlough" do you mean 80% of your regular salary?

What does your contract state about sick pay, as you could be entitled to OSP which would likely be your full salary.

A company can only claim back SSP or furlough, not both.

Presumably you told your employer that you're sick, which is why you had a return to work interview and you've been recorded as absent?

Paid less than normal pay and initially told I was on furlough but when asked face to face he would not answer.
My point is if I was on furlough then I was not ill on sick pay.
Contract does not cover this situation.
Will have to see how this pans out over the next couple of months.

SSP won't enter into it. The OP has said he is salaried staff and normally paid in full if off sick

Within the new rules for employees who rely on SSP and don't get paid, a company can now claim back 2 weeks SSP from day one for Covid related isolation, normal rules will apply for SSP paid for sickness

OP if you have been receiving your normal furlough pay @ 80% while of sick, it maybe a stretch to convince them to pay your full salary for 3 the weeks that you were sick, if this is what you are getting at.

I got furloughed while on long term sick, apparently they said they it was perfectly legal and above board.

Still can't get a straight answer so will save all communication and see how this year pans out.
