How long after a car accident can someone claim?

They have 3 years to claim for injury, and 6 years to claim for property damage.

Why would you accept 50/50 liability for something you'd not done? I'd not accept 10% blame if someone else was 100% in the wrong!

Personal injury claims are generally limited to 3 years from date of incident as far as I'm aware.

What I’m worried about is that if they suddenly discover that they have had an injury right now. Then the 3 years time limit will change.

However I suspect most injuries for car accident should appear within days no matter how minor or serious

I was told with no witness and no CCTV then claims are usually settled 50/50. I thought for the sake of 500 pound extra it wasn’t worth it.

However I should of considered long term.

Funny this. A few years ago I hit a car from behind one morning but I told my insurance company that he reversed into me (You have to try don't ya :-) ) The insurance company told me that the default position as that the probability of me hitting him from behind was higher than he reversing into me and therefore I was liable. However not in your case.

The three year time limit is a provision of the Limitation Act 1980. Please do not worry about things that you need not worry about. If you are worrying about an injury unknown for years after an incident (and the consequent special limitation period under the 1980 Act) that's a more complex subject, but you appear on the facts disclosed to be worrying needlessly.

PS: Anyone who, in a UK context, says "Statute of Limitations" gets a Paddington hard stare. Ditto for "LimitationS Act".

That’s right. I seem to be worrying about the unknown.

The unknown being is that the lady in question decides to claim and she finds a solicitor to say that she only found out about the injuries recently rather than the day of the accident.

Or she slips on ice. Gets whiplash and decides it was the accident that caused it

Also the sky might fall on your head. Or aliens might invade. Do you worry about lots of things like this? How about "I passed a speed camera when I was doing 30.00000001 MPH 13 days ago and I have not slept since. Will this torture end tomorrow?" That is quite a popular one here.

I would just like to do my civic duty and allay the fears of anyone suffering this torture at the moment.

I have driven past lots of speed camera at 30.00000002 MPH and never recieved a ticket, so you should be OK and can finally get some sleep.

That’s a fair point. I think a lot of people worry about the unknown. Me included.

I guess in my case. A simple crash it is accepted most people will know that they are injured then and there. If not a few days later.

I’m my case 6 years has gone. Anything could have happened to that person. I’m sure they probably been in more accidents since.

.. because a settled 50/50 claim usually has a much smaller impact on your insurance than a disputed/outstanding claim, in the latter case the insurance company exposure is unknown and the worst is assumed.

My mother had a potential outstanding claim affecting her insurance for 6 years, would have been much much better to have admitted 50/50 at the time.

Seriously, and trying to be helpful, why fixate on that one incident and that one person? Whether that person has or has not had other accidents, that doesn't impact on you. Forget about that person. You had one random encounter with them and it had no great significance. You had insurance. Small problem occurred. Small problem went away. You surely won't still be worrying in another six years.

Thanks you have been very helpful. Your are right. It was a small problem that’s has gone away. I’ve never thought about it since now.

I’m just worried if the small problem which has gone away comes back. As in they make a claim for any injuries or PTSD etc.

What if they do? You’re not paying so why does it matter and you only ever get asked about claims in the last 5 years at worst and that date surely must be when you had the accident not whenever a random claim appears.

I was badly injured in a motorcycle RTA in 2010 when two lying scum, hit me head on @ speed on my side of the road I have suffered from shoulder, back and hand trouble ever since, alone the mental anguish.
My specialist biker solicitors “ we are on your side “ White Dalton, were f useless, I was regally shafted by them.
