Hello guys
Just bought BMW 520d 2011 135k miles from autotrader shop yesterday.
I went to check the car in local mot and garage and the car become poor condition not as I was hoping.
Car passed mot with a faults: Hedlamp slight defective ( water and condensation after coming back home in the rain), oil leak from engine compartment( going to verify how bad is today), all shock slightly corroded. Overall car just barely passed and poor condition.
I feel like did bad mistake frown I called seller asking for refund, offered him 500£ extra for his hassle.)
He refused.
Do you thing this issues found are enough ground for a winning case and refund.
Sold with no warranty.
Thanks for any advice.

Why on earth didn’t you buy the car with 12 months ticket ? Or did you put it in early ?

It’s a 10 year old car @ 135k - it’s going to have minor issues

Headlight might be able to be fixed with silicone

Suspension is normal

It still passed , so a roadworthy car !

Oil leak is worth chasing dealer over - you will need to give them a chance to fix it

I wouldn't bother potentially paying out costs if you're thinking along the lines of seeking legal advice/action. The 'faults' highlighted are, arguably, not unreasonable on a 135,000 mile 10-year old car and it passed an MOT, so not much chance of proving it was unroadworthy at time of sale. Many people would say that best practice is to check it over before purchase, not afterwards.

Yes my fault not checking the condition properly.
I was put off by mechanic today, and was hoping to reverse transaction unluckily.

Did you buy over the phone/ internet? Did you use a credit card for some or all of the funds?

If you've bought the car from a dealer/trader; you have rights...

There is a LOT of info re this online; stop asking on here and get reading...

If you want perfect, buy new. It sounds like there's not much wrong with it considering its a 10 year old high mileage car.

Saying that, it's a 5k car with relatively expensive running costs so if you are expecting years of easy trouble free motoring, you may be disappointed.

I'd wager that you could buy any 3+ year old used car on the market, stick it into a reputable garage to see what it needs to make it 100% right and they will give you several sheets of A4.

I paid by debit card.
Went there to see defferent car and bought this bmw instead.
I read a lot about this purchase ": You have protection under section 75 of the Consumer Credit Act 1974 and the Consumer Rights Act 2015.
The vehicle should be of satisfactory quality, fit for its purpose and as described."

The question is if this issues qualify for a claim.
Anyway I am not happy with the car at all. And want return.
Small curt case shouldn't be expensive I think( never went this way).
I never felt that bad with decision made I will try to reverse it.
If not then no other choise than stick to it.
Dose anybody went this way with successful outcome?

Yes that was my mistake... I realised that too late!!

Did you buy it without a current MOT or was the MOT you had done a check for your own peace of mind ?

Mot running out within 2mc. I done myself to make sure all ok.

As said previously you should have asked the trader to put a fresh MOTon it. In reality for the age of the car it doesn't sound too bad.

You're wanting to claim the car isn't fit for purpose... but it just passed it's MOT? Regardless of advisories, it passed. Given that it wasn't a distance purchase (telephone/internet) I think you're going to struggle. It sounds like you've bought a lemon, but that it wasn't advertised as being anything more than that... It's a roadworthy car that's soon going to need some work to keep it roadworthy.

135,000 miles will normally mean plenty of wear and tear all over the car in my experience. I can't see much come back happening, although happy to be told differently if anyone knows the legalities better than i.
I tend to buy Cat D/N rather than with mega miles if i want a car i can't afford in great condition and low miles, etc.

sounds much like any other 10 year old used car ...buy new if you want no faults

or next time get under it with a magnifier before agreeing to buy it

The car can’t be expected to be in perfect condition at that age and mileage, the only real concern sounds like the oil leak but the dealer should fix that. Ask him to sort the headlight too if it’s causing blown bulbs etc. It doesn’t sound like a total disaster at this stage.

The thing is its an 11 year old 135k car, surely an oil leak is going to be expected.
