my wife got a fixed penalty tonight (first time in 15years) she was done for something that I think is a bit dodgy. What say you.

In Newport there is a pedestrianised area, the signage at the road start is a typical white circle with red band (no cars) but under this it says 8.30am to 5.00pm. It was 6.30pm so well outside these hours yet she was booked. The dirty rotten dog of a police officer said "this should be read to say that only vans were allowed during these times for loading etc"
So what say you?
I shall be going via there tomorrow to take a photo of the sign and post it here. Then on a vote i'm gonna decide whether we appeal or not.
If I gotta sell my Maser to pay the mortgage im bolloxed if im giving them £40.00 for the sake of it.

If you can prove that it was 6:30 then go for it. I read some other PH`ers post about bus stop lay-by`s and the law laying its self down.

To enforce speed they seem to require photo or laser evidence? Does this meen the police need a Rolex or similar to enforce time restrictions?

The sign literally means 'NO VEHICLES' not No cars. The restriction will probably have written under it except goods vehicle for delivery between XXXX and XXXX. If it does say that and she went through there between the restricted times and she wasn't driving a goods vehicle, then she would rightly have been FPTd'

If however the limit refers to no vehicles between the two times and there is no mention of goods vehicles loading, then after the restricted time period, she will not comit an offence.

Go and look at the sign carefully. Photograph and post it here and then I will be able to give you a definitive answer.

Or to paraphrase MadCop (if he doesn't mind) then if it is what you say it is, you're in the clear.

And to chuck a CarZee Smoke Grenade in, so long as you're right about what you saw, and I know we're right about what the law is if you saw what you think you saw, you should let it go as far as it can and make as much noise as you can and get this bastard a serious kicking and next time maybe he won't be such a prick.

ok heres the pic of the sign, sorry its so big but i wanted it to be clear.

The time on my wifes ticket is 7.45pm, she was using the road to gain ACCESS to a game club situated on this road to pick my 11 year old son up.

let the vote begin was she in the wrong for the offence of using the road? I must stress she was not booked for stopping. She was in fact flagged down just where that silver car is on the right there.

I'd say yer in the clear - sign does say "Except for Access" and states the times. Sorted.

I'd agree with you on this... I'll read madcop's response with great interest, since if you are not supposed to use it at all, then I've got away without being booked MANY times before in similar situations.

Hmmmm, doesn't it mean:
No Vehicles at all 11am - 5pm
No Vehicles Except for access Midnight - 11am, 5pm - Midnight
No waiting at all, ever

Did she get a ticket for driving or parking? If driving, surely she could come up with some "access" excuse.

No doubt madcop will set me straight if I've got any mistakes in this...

Looks like she's 100% in the clear from the sign.

One thing worries me, though, and perhaps the more legally minded can explain it to me:

If nobody is ever allowed to park in the zone and you are allowed in for access sometimes then by definition you can't stop to get access to whatever it is you want to access. If you don't stop then you're just passing through and if you're just passing through you're not there for access, so in the end nobody can drive into the zone at any time at all...

If this is what they're trying to achieve, why doesn't the sign just say "No entry", or better yet, build a wall across it?

yeah, I know. My question is more general: if you're allowed to drive in for access, but not to park, what good is the access? If you don't stop then technically you're not there for access and therefore not allowed in in the first place? WTF?? Just looks like madness to me!

{edited to add:} I guess your son could be persuaded to try a flying ninja-style leap into the open window of the car as it drives past! You'd be meeting all the requirements of the stupid sign then!

IIRC stopping to drop off/pick up passengers is not classed as parking. Not sure of time limit etc, but you get the gist?

I think unless she was accessing something only reachable by driving along that street, then she was correctly given a ticket. The sign states that the road is entirely pedestrianised from 11am-5pm and then open for access only at other times. that would usually be used to provide access to vehicles delivering to shops and businesses - hence the coppers reference to vans. If she was just driving down the street and not there for a specific reason she should have been issued the ticket. best hope is to plead poor signage, which it is.
