Good afternoon all,

I am looking for some legal advise in regards to verbal sexual harassment my wife received from a well known reputable high street store all of which has been captured on video/audio.

I don’t wish to delve into all the details at the moment however as this has effected my wife emotional I now I feel this needs to be taken further. We have had to increase our CCTV and external lighting because of her worries.

Can anyone offer recommendations to sexual harassment lawyers or no win no fee type organisations. I have never been down this road before for any advise on what to do or avoid will be much appreciated

Thank you,

What do you want to achieve exactly, cash?

Have you made a complaint to the company or are you just wanting to go biblical on on straight off the bat?

If it's a larger organisation then the head office would be the first port of call. Don't even think about going legal until you have communicated with them.

Even if you end up going legal you need to think and behave responsibly, with a level head and desire to see the matter resolved appropriately. Legal action should be seen as the last resort.

Does your wife work at this store, or was she a customer? if it's the former then HR is the obvious first port of call, and if it's the latter - the company head office.

How do you know it "has been captured on video/audio"? Have you seen it? Relying on the presence of cameras doesn't necessarily mean the incident has been captured definitively, and I would expect sound recording to be atypical for most high street CCTV installs, as the ICO considers it intrusive in most circumstances.

Don't go no win no fee, as they say you get what you pay for.
It will cost, but the police should be a starting point if you have video/audio.

Thanks for the responses.

It actually happened inside our house therefore we have the footage and audio of it taking place.

We have contacted head office who have given us the cold shoulder, this has been escalated through several different departments too.

Their stance is that as they have employed a sub contact company to carry out the works the issue is nothing to do with them.

In terms of what we want to achieve. Firstly it would be a sincere apology, it has generally shook my wife up and she now is not confident about having trades and deliveries at our house, so I feel there is some compensation we feel should be made.

I feel like we have come to the end of the road with the retailers head office and if we want to peruse we need to go with good advise or a lawyer, my only concern is how costs could spiral and we end up in an even less of a position.

I'm not sure how increased lighting/CCTV will help unless there were threats to harm her at her home? IME pandering to hypervigilant behaviour after trauma/PTS related events does not really help. In the long run its better to talk through the anxieties to resolve them were reasonable rather than take actions that may normalise the anxiety reaction.

Ahh there it is. Your wife is so distraught and needs extra security on the house but a few hundred pounds will make it ok.

What size company are we talking about?

For a larger company, email their CEO - https://www.ceoemail.com/ with a clear statement of the events and asking to talk through with him/her their proposed response, containing references to how you have already tried to raise it.

If no response then you could find out their board of directors and write to them.

Hi - apologies for being pedantic but I assume you meant the sexual harassment was from an individual rather than the Store. Depending on the nature of the harassment it may not be a criminal offence. i think the first thing you need to do is decide whether it's a Civil issue or a Criminal issue - if it's the former then decide what redress you want and approach the Company, if it's a criminal offence then straight to the Police.

Have you taken up the issue with the sub contract company? I would have thought that the company would have given you their information if they are trying to wash their hands of it.

Your probably more likely to get somewhere with them, as it will be their reputation, and their business on the line.

You may get a more helpful response if your able to give a bit more information as to what actually happened, someone may be able to clarify wether it is sexual harrasment, or wether it falls under something else.

I would also suggets, that if you believe your wive to be a victim of sexual harrasment in your home, you should probably be reporting to the police.

Can you elaborate on why you felt you needed to increase the CCTV & lighting? Was there some kind of threat made?

It’s amazing how money can seemingly fix anything!
This sounds like a police issue, unless of course it’s just the hope of an easy windfall thats the driving factor…

If it was a "reputable high street store" but happened inside your house, and was actually by a "sub contract company" - then presumably it was a delivery? I'm not sure why you'd chase the high street company rather than the delivery company (or whatever type of company it was) if that's the case.

Although at the point your story changed from : "It was so traumatic that we need additional lighting and security" to "It was so traumatic that we want financial compensation to make it better", I think logic took a backseat.

Because the contract was with the high street store?

If I bought something from Ikea (by example) and their subcontractor say, damaged my door in a delivery then I would be talking to Ikea.

That's assuming they was doing a delivery for the store we need to know the actual circumstances

This. If a courier loses your Amazon parcel, do you claim from Amazon or from the independent courier who delivered it off the back of his family MPV?

OP - without being specific, you need to overview what actually happened. Your posts intimate that you had a delivery and the driver behaved inappropriately towards your wife. Did he make advances to her? Send inappropriate texts? Something worse?

Gory details aren't necessary but context is.

I wouldn't - I'd be talking to the delivery company. (I'm not saying that's necessarily right, but it's what I would do - so I guess we all have different opinions, which is why the OP talked to the high street store)
