Paid for parking.. got PCN, appealed and now want drivers
Discussion
We parked in a shopping centre who’s parking is monitored by Highview Parking LTD. There are no pay machines and you are instructed via various signs to pay on the Parking Jockey app. That in itself was a right ball ache but upon entering our registration number it determined we owed £1.70. Duly paid and exited the parking immediately.
Couple of weeks ago a PCN arrives stating we either didn’t pay or didn’t pay enough for our 33min barrier to barrier stay. I appealed via their online process stating the parking was paid for via thier app and included a copy of the payment from my bank account and a photo of the centres charges showing the £1.70 more than covered our stay.
Today I get an email reply stating the following…
“ Dear Sir/Madam,
Thank you for your correspondence relating to your Parking Charge.
The representations stated in your correspondence have been noted and considered. Please forward to us the full name and address of the driver at the time this charge was incurred so that we can update our records accordingly.
We are placing this Charge on hold for 14 days from the date of this email to allow you to provide the details requested.
Yours faithfully,“
Now I’m guessing they are trying to trip me into naming someone so they can push to pursue this erroneous charge for whatever reason.
How do I respond from here to get them off my back. Never had a PCN before and I fear my usual stance of GFYS wouldn’t really solve things

Respond that you do not need to provide the name or details of the driver and refer them once again to the data you've provided that the car had parking paid for (I presume registration noted and payment time/date).
Agreed. If you have complied, have supplied and still have the evidence, write that you will not respond further. Any further correspondence from them will be considered as harassment, except for a letter of apology/agreement.fastbikes76 said:

Engage with them but simply to state you are not obligated to provide the details of the driver at the time of the alleged breach.Couple of weeks ago a PCN arrives stating we either didn’t pay or didn’t pay enough for our 33min barrier to barrier stay. State that you have provided evidence that the period of parking has been paid for and evidenced with your original communication and that they have 14 days to cancel the PCN and notify you accordingly or provide a POPLA code (as they are part of the BPA).
If you hear any more from them without cancelling have a look at pepipoo or MSE forums as they will have template appeals for POPLA
My car once got a parking fine notice on the windscreen despite the driver having paid and clearly displayed the ticket in my windscreen. When I tried to follow the company's appeals procedure online it wouldn't register unless I provided the driver's details. I didn't, and they and then their solicitors pursued me with threats of court action for not having appealed using the correct procedure.
When it got to the point of threats of court action I asked for photographic evidence of the infringement. Photos were duly supplied - showing my purchased ticket clearly on the windscreen. The ticket is now safely locked up awaiting its day in court.
Needless to say, it's still waiting....

Was it fully displayed? We parked on Southend sea front, with the ticket in the Fabia windscreen ticket clip. The Council’s issue was that the day number was partly obscured by the black screen band (UV protector for the screen adhesive). We still had the original ticket (I keep these things, somehow!). They mumbled and grumbled, and let us off, saying something like ‘although it was not properly displayed, on this occasion we will let you off’When it got to the point of threats of court action I asked for photographic evidence of the infringement. This was on an ANPR style system so photos of vehicle entering and exiting site were provided with the PCN.
I’ve replied for now stating I’m under no obligation to provide driver details and to refer to previously supplied evidence showing full payment was made. I requested the erroneous PCN be cancelled within 14 days etc as advised earlier.
I doubt they will listen and they can FRO if they think I’m going to waste my time defending this stupid charge.

What time stamps are there for the photos?
If so does the time interval correspond to the fee bracket you paid for?
Basically, you say 33 minutes time interval.
Your claimed time or their system time? If their time then does the fee you paid and can prove payment cover 33 mins? If so state that in a reply to them with your proof and say that is the end of the matter.

Their time stamps of entry and exit photos show 33min total. I paid £1.70 as instructed by their app , you have no choice to pay anything other than the amount they stipulate. Fee paid covers time on site If so does the time interval correspond to the fee bracket you paid for?

I’ve replied stating all the above and referring to evidence already provided in initial appeal.
