Child maintenance loophole?

My wife has 2 children with her ex, he pays maintenance through CSA. Every year she gets a letter that he has earned £32k, but they’re basing her payments on his £16k salary? Every July they do a review, so the month before he always goes on the sick, sends them wage slips in and that’s where they get the £16k from, then he goes back to work doing all the overtime. How is this possible? Why don’t they look at the year overall?

Not really a loophole. I had to supply three payslips to effect a change back in the day (and only of it had gone down by more than 25%).
Probably worth talking to someone at CMS or whatever it's called this week. They may be able to base the money on more than one pay period that he has gamed. Note though that if the bloke is deadbeat enough to game it this way, he may take advantage of the actual loophole, and quit his job.

Always sad to read things like this as it’s the kids that miss out. Is there a way your O/H take payment direct?. Iirc when I looked if they act as the intermediary there is a 20% deduction. Do the kids stay with him at all?. The CSA website is handy to work out what the payments should be.My wife has 2 children with her ex, he pays maintenance through CSA. I ran my details through the CSA calculations when my ex left with my son. Just added £20 on top every month and pay her direct. The extra was to mitigate against any funny shenanigans she may of pulled.

Yes there’s a calculator on there, for his actual earnings and the 1 day a week he has them he should be paying her just short of £80 a week, she gets £30 a week.I ran my details through the CSA calculations when my ex left with my son. Get in touch with them. Explain what’s going on and see where it leads. £30 Pw for two kids is derisory.
Look at it another way though. Karma catches up with everyone eventually, as the kids get older just be open about what happened/going on etc with how he hasn’t paid and the stunts pulled. In the long run it’s his loss and he’ll have to live with shenanigans he’s pulling.

I don't understand how this works tbh.
Its gross annual income according to their site, so in effect unless he is actually taking the pay cut its always going to average out to his annual salary.
They should see that from HMRC IMHO so overtime etc would be included - unless they do it differently now.
Doesn't seem right somehow!
I have no time for anyone that doesnt pay their full dues - as someone who has very little left after making sure I pay exactly what I should.

Wife's best mate, ex-husband is a partner in a regional law firm, also paid next to eff all for his 3 kids. I'm not sure how he managed that given that he's had a 911 Turbo, Cayenne, and currently an RRS.k all for his daughter from the age of 2, scum....
