Fleabay - Faulty Item
Discussion
I don't sell on ebay because of everything I read online about ebay siding with the buyer but I do buy stuff, mostly have no issues
I've just bought a supposedly working games console. Its arrived and it isn't, I don't believe the seller
Seller is saying it was working when it was posted, has provided photos of a TV with a working playstation interface.
I've said lets just let ebay sort it if you wont accept a refund.
Not the end of the world in terms of money lost, but annoying none the less. Is there anything I can do in this case or does ebay really side with a buyer in a situation like this.

Now been offered a 50% refund to settle case, so obviously knew it was faulty.
Or, has also stated he will accept the return (which Ill have to pay for of course...) he needs to check it over to make sure it was not tampered with. So what happens when he says I sent a different one back (serial will match I guess), or swapped out the internals or something? Then I'm the console +£10 postage out of pocket.

If you open a faulty item case on eBay then eBay will authorise the return and force the seller to provide you with a postage label for it's return, or give the seller the option to simply refund without receiving the item back you do not have to return at your cost.
Also just to make you aware eBay will often allow the seller to purchase a Royal Mail delivery label from eBay directly, this is fine but if you use the label and take the parcel to a post office they will sometimes try and tell you the item is over the label weight as they don't understand the agreement eBay has with RM, take the parcel to your local sorting office if it comes to that and they will accept it.

Is there not a caveat for that? ebay page states the following:Also just to make you aware eBay will often allow the seller to purchase a Royal Mail delivery label from eBay directly, this is fine but if you use the label and take the parcel to a post office they will sometimes try and tell you the item is over the label weight as they don't understand the agreement eBay has with RM, take the parcel to your local sorting office if it comes to that and they will accept it.
Who pays for return postage?
The seller pays for return postage if the item was damaged, faulty, or doesn't match the listing description, or if they offer a free returns policy.
You pay for return postage if you're returning the item because you changed your mind, and the seller's return policy states that buyers are responsible for return postage.
So suggests a faulty item is down to them to pay, but also says I have to pay if the sellers policy is responsible for return postage.
Assuming you are using a PC and doing it via the e bay web page
Find iten from your purchase list
Click on item
Click on blue return this item box
Expand box downwards and choose option - Doesn't work or is defective
Click next and follow instruction
You MAY have already done that IF you have opened a case
In the meantime re box the item if you want to take a picture of the box with the item in it before you seal it great but you won’t need it
Now what has happened is this.
You have started a return due to the item being faulty
The seller now has effectively a charge against his account of the money he received from you. Whichever payment system he is on
The seller is obliged to send you a return label if he doesn’t he can in some cases buy one from e bay at a fair price
The seller has to make that label available to you within a certain period
It doesn’t matter how many messages he sends you its now an open case assuming you DID open a case above.
If he doesn’t provide a label e bay will send you one
Its important you follow the labels instructions and get a receipt from the Post Office or whatever
Once he receives it the seller has a few days to refund you if he doesn’t you escalate the case

As a general rule, don't do anything 'outside' of eBay.
Use their internal processes for absolutely everything, including messages etc.
This. The advice also includes postage labels when you send the item back. If you send it back yourself it can cause problems with EBay not knowing how to track the parcel (guess how i know).Use their internal processes for absolutely everything, including messages etc.
