Distance Selling Cars - Delivery / Returns - Who Pays ?
Discussion
I've read the Regs and many guides and they say that the Buyer can cancel within 14 days and "get a full refund"
However it doesn't mention delivery costs - it does say that return costs may be excluded and to read your contract
Is delivery refundable if it's arranged & paid for by the buyer ?
I'm regularly being asked to sell cars / bikes long distance and I'm happy to do so if I'm sure that I won't be stung with delivery / return charges should they change their mind within 14 days

outgoing post must be refunded (but only to the standard charge - not if the consumer selects a more premium option)
return is down to the consumer
i would highly recommend you specify it in your contract.
bear in mind separate rules apply if the car is being returned because its faulty under the consumer rights act 2015

if you want a situation whereby the consumer arranges collection then you need to arrange the transaction in a way that is truly them arranging their own collection with a separate business.
that way its not a delivery you have made
i would suggest you make it clear again in the contract that if they arrange their own collection is a separate agreement and not part of the refundable amount.

Is it really that easy? My experience of car dealers is they are helpful until they have your money, then as soon as anything goes wrong they don't want to know. Then the person you need to speak to is never available, they never call you back, refuse to do anything and generally fob you off until you lose the will to live and give up.
I am assuming if you want to return a car they will do everything to delay this so you are outside of the 14 days and then it is tough luck?
I really struggle to believe they will say "No problem, we will come along tomorrow and collect the car with zero cost to yourself and refund you money immediately"

Yes there is quite some disconnect between the theory and reality most dealers claim to be unaware of the law and several of the largest ones claim the consumer rights rules don't apply 😂I really struggle to believe they will say "No problem, we will come along tomorrow and collect the car with zero cost to yourself and refund you money immediately"

If the dealer digs their heels in or denies any knowledge of the law there is going to essentially be nothing you can do.

Exactly, and in this situation what exactly are you going to do? Call the police? Contact a solicitor who will tell you they require £1000 on account before they will look at the case and it is £300 an hour.

In the old days it's where trading standards would step in but in my experience these days they don't do anything
I've tried to raise complaints about main dealers selling clocked cars and they did nothing
The next option is to take them to court yourself which if you are in the right means the dealer could end up facing a huge bill - assuming he doesn't just go bump.
The problem is that I try to run a legitimate operation which is hard when many of the competition, don't
