Interesting/different a "butty van owner" doesn't want people to park in 'her layby' for extended periods on a public highway as it affects her ability to trade.
She is asking people to move or not park in a public layby, yet people seem to think that's ok.
Ps the other 'non working' biglaugh layby (it's just smaller) referred to is about a mile away on the same road in a much poorer area for pedestrians so an extra 2 mile walk and 4 extra crossings over a busy A road rolleyes

Personally I can see her point of view.

If there is another lay-by, even if it is smaller, then given they're parking then walking, then I don't see an issue.

I can also see her point of view. I'm going to assume she is legitimate and has a license from the council. She should ask them if there is something they could do about it.

Yes. She does. Not sure if she provides a toilet as of old policy scratchchin
There was one trader who used to knock on trucks and wake drivers up if they 'were in his space' and no it wasn't a marked 'trading bay'.

Then I think she has a point, she has paid to use that layby to generate trade in order to have an income. The council have declared that they layby is suitable for the use that she has permission for.

However laybys are not designed to be used for people to park up all day and go for a walk. So actually I would say its the walkers that should move and not the lady

Totally understand her issue, not sure why it's comedy gold - if the layby is filled by none customers then it effectively closes her business.

Not sure why it is ‘comedy gold’ either. I didn’t laugh. If she asks them politely if they don’t mind using the other lay-by and it enables her to carry on trading good luck to her. She’s not trying to lay down the law she’s just asking people nicely if they’d help her out.

Layby is layby with no parking restrictions.

Maybe that's why people leave signwritten taxed and insured cars/vans in them as adverts.

In another local town very very strapped for parking.

The 'curry van' is parked 24/7 in the local park parking zone taking up 25% of the available spaces.
Maybe they could relocate to free up parking spaces?

There is no right to 'passing trade' with those type of establishments, it's a business risk. As others have noted you don't own the road and there are no restrictions on it.

I didn’t say they weren’t allowed to use it.

What I said is that lay-bys are not designed for people to park up and go for a walk all day.

Their intended use is for people to be able to pause from driving and have a break, or if there is an issue with a car etc. It’s not a car park for days out. That’s why tourist attractions and forests have car parks. If people are blocking up a lay-by so they car walk for hours on end then they shouldn’t. Even if they can

I needed to pause in a layby but there was no room. It was really annoying as my kids were really sick and needed to get out the car.

There's always a sandwich van parked there which attracts artics and leave no room for others who really need the space.

Obviously a made up story but that's another way of looking at it.

It's not her layby. Maybe she should offer specials for walkers.

I'll remember these when people complain about getting tickets in legitimate service areas for staying over 2 hrs on private land.

In this case motorists are doing absolutely nothing wrong.

But lay-bys have the same intended use as service stations and to an extent the emergency lay-bys on managed motorways.

And people abuse the service stations hence the two hour free limit. Otherwise everyone would be using them to car share and parking all day.

Do you see the difference between a car park and a layby

She's elected to take on a business that relies on customers being able to park but the business comes with no parking.
Her request isn't "comedy gold" but she knew the risk up front.

A layby without any additional restrictions is for public use so unfortunately for her, tough.

Its pretty much like a chippy trying to stop people parking on unrestricted public roadside parking outside their business on the grounds that it should be for customers only.

Doesnt work that way....

I can see both sides of it. Maybe she could apply to the council to have a maximum time restriction applied to the layby e.g. 7am-6pm 2 hrs, no return within 1 hr or something.

This IMO. It's unfortunate that the walkers / parkers are taking up space that would otherwise enable her customers to park, but on the flip side, it would be unfortunate if her customers prevented someone with an emergency or broken down vehicle to park in the layby, especially if it was a NSL trunk road with limited (safe) alternative stopping places.

It's simply a risk of her trade, and should be pretty obvious when operating out of a layby that you don't own, you just have permission to operate from.

She could try reasoning with the walkers and maybe they'll be sympathetic and park elsewhere if possible, but ultimately they're not obliged to and have as much right to be there as she does.
