I think the expression is often related to insurance- ie a potential insured has a duty of disclosure, but they do not have to disclose information that the insurer should already know as a matter of normal experience, such as the performance figures of a car (once the make and model has been disclosed).

Still can't think what the expression is though!

Were you thinking of ”Caveat emptor”?

Literally means ‘let the buyer beware’, and is a disclaimer intending to put the onus on the buyer to do their own due diligence.
