Some useless careless driver (of the female type) decided to broadside my lovely TIV this morning
What a mess all down the passenger side and my alloys ! jeez why did she have to attack me !!
My pride and joy, cared for, polished and running oh so well now with a great big scrape down the side.
At least the insurance company (Carole Nash) were very helpful so car is off to see Richard Thorpe in Sheffield, hope he's good ?

Sorry to hear!

At leats there seems to be no hassle with the insurance. I hear Richard Thorpe is excellent and hopefully he will have you running again soon.

It's getting worse by the minute. The insurance company have phoned up and said that because the other party are not accepting liability they advise me not to hire a car because I will end up paying for it. They say it's likely to go 50 50. But how can this be when the damage my car suffered clearly shows that she ran into me. Is this just another case of the insurance company taking the easy way out and accepting 1/2 the liability without any thought to the injured party. It makes me so mad when you pay through the nose and the only time I have ever claimed and this happens

If you've got legal cover then it might be worth using it. Can't see how if the damage is all down the side of your car it can possibly be argued that it anything but the fault of the other party. Did you have any witnesses?

I suspect it is the other party's insurance company trying to minimise their losses but you should hold out for no loss on your part.

Hope this gets sorted out

think you will find its standard practice for the other insurance company to issue a not a fault claim.
don't let them get away with it.

Is it obvious from the circumstances that she was at faujlt> I.e. you were stationary, or she drifted into your lane etc? Otherwise you may well be left unable to prove it was her fault, and without proof, witnesses or a confession you may struggle to pin the blame on her.

Good advice however, in my experience, LEI's sell Before the Event (BTE) policies for around £10-£15 of which £2 is underwriting premium. If there is a way of settling the claim without having to fund what can be expensive litigation, they will do so.

They have whats called a "reasonable prospects of success" clause and may say to you that there are "no reasonable prospects of 100% success" and suggest 50/50, if you reject, they withdraw indemnity.

To the author feel free to give me a call, I've provided my personal details on an e-mail to you. I might be able to help.
