Speeding Prosecution
Discussion
I need help.
I was caught by a uniformed officer last night- recorded speed on the laser...101mph.
Stupid I know, and I have no excuse, but in my defence, its a road i know well and completely empty.
Anyway, I am more than prepared to take the punishment and I will not dispute the charge in anyway whatsoever. The officer told me that I should expect a 28 day ban from the magistrates when I go to court- does this sound right ?
I would prefer this than points...can anybody advise me how to act in court and possible punishments ?
Thanks in advance,
Rob
You were not offered a Conditional Offer because your speed was above the ACPO Guidelines i.e. under 85 in a 60 and under 95 in a 70. As a result you will be booked for a Court appearance where the Mags will look at the case and most probably impose a ban.
If you prove that a ban would cause undue hardship (loss of job, economic problems etc) and have evidence from employer etc then you can ask that they don't impose a ban.
You will have to marshall all your thoughts and work out a prepared speech of mitigation i.e contrition, won't happen again as it was done in extreme circumstances, road safety factors, no danger, straight road, light traffic, no one at risk etc.etc.
You can do this one of three ways:
(1) D.I.Y. in presentable mode of dress with the aid of the Clerk of the Court.
(2) Employ a solicitor.
(3) Get to Court early, seek out the Duty Court Solicitor and see if he will act as Advocate which is free.

Thanks for the reply-
Ive been reading other threads who offer different opinions as to the punishment- with a ban i would keep a clean licence after- with points i will not have a ban (for insurance purposes)
what do you think is best for future insurance purposes- I'm 23.
Thanks,
Rob
