I was the victim of a pretty brutal assault a few weeks back.

It involved severe facial injuries and a stab wound.

After 8 weeks and witnesses refusing to come forward the police would like to close the crime. They feel the cctv is inconclusive and the witnesses are unwilling to give statements.

My question is, Can I ask to view the cctv that the police have reviewed?

You’ll be unlikely be able to see the CCTV.

If they do file it with no further action, you have the right for it to be reviewed. They should explain this to you, but if not Google ‘Victims right to review’ and your police force which will explain what the process is.

Nothing stopping you doing a private prosecution.

The question is do you know the attackers, were they interviewed?

Currently a private prosecutor can recover all their costs from public funds even if the defendant is acquitted.

The CPS guidance is irrelevant unless a file has been submitted to CPS for advice and CPS have made a decision

From what the OP says Police are closing the investigation as there is insufficient evidence ...

This is correct.

Even with the CCTV, no witnesses means your case is likely going nowhere.

I would put more effort into getting the witnesses to do the right thing.

Properly best not to do that or you could be looking at witness intimidation.

no witnesses to many murders, the difference is the police actually investigate it, instead of tossing off.

Bit different though isn't it?

You can't realistically expect them to run a major incident room with a full investigation team trying to find every scrap of potential evidence & follow up thousands of lines of enquiry etc. for every single assault. It's just not a tenable position.

With a stab wound in the op I would hope they would treat it as a serious investigation, stab wounds can go very wrong for the victim very quickly.

Why are the witnesses not playing ball ?

There are stab wounds & there are stab wounds. They aren't all as serious as one another.
I appreciate we have not seen the OP's injuries, nor have we seen the video or other evidence to make a valued judgement.

VRR is only applicable when a suspect has been interviewed.

“There are stab wounds & there are stab wounds. They aren't all as serious as one another”. ??? Is that comment for real? That must come from a ‘guy’ who has never been stabbed. Believe you me a stab with any blade is fking dangerous AND fking painful. Tell the police during the attack you were called a “fat poof” and they will jump all over the case for PC reasons.

You might not like it, but that doesn't alter the reality.
They will look at 'are the injuries (potentially) life changing?'

Yes I've been attacked with a knife.

A wounding is a breaking of the skin.
That can be a scratch drawing blood, or being carved open with a machete.
They are both a wound, but clearly not the same severity, so they wouldn't be treated as such.

I take it you know who stabbed you? Incredible that they must have a witness, say, as all you need do to stab someone then is just wait until they are alone it seems!

When I was stabbed by my first wife, I was interviewed by the police in St Thomas's hospital.

Despite being admitted as an in-patient, I was sternly lectured by the two police officers about not provoking her in future, told there was no prospect of her being interviewed let alone charged and made to feel as if I and St Thomas's A&E dept, who have a policy of calling the police for all stab wounds, were wasting their time.

So no, based on my experience, the police do not take all stabbings seriously
