6 points and £640 fine, for overtaking legally on a broken white line with nothing coming the other way, just because some professionally offended DCW tt objects to someone getting a move on. Driving without due care? My arse.

With the exception of possibly exceeding the speed limit (it's hard to know, although I don't actually think the overtaking vehicle is doing 40 or less biggrin but it doesn't look as if it's doing more than maybe 50ish) it looks to me to be a nicely judged pass in a good location, on what looks like could be a road without many safe overtaking opportunities. Possibly a local driver with good knowledge of the road and the sight lines etc...

I realise we may not have the whole story from prior to this clip, but junction aside (still not illegal though), I really struggle to see the problem with this overtake? The junction is obviously clear, the road ahead can be seen to be clear, and there is a broken white line??

Seriously, it now seems to be an offence to overtake anyone, anywhere. mad If these type of incidents lead to this sort of punishment, we may as well give up.

What boils my piss too, is that I've noticed the people that get so stty about being overtaken often have inoperative or faulty lights, and quite possibly are those that drive everywhere 'safely' at 35mph...with bald tyres etc...pricks! (Honestly, if the police decided one day to check the tyres and general roadworthiness of all the cars parked in my local supermarket car park, there'd be a lot of people walking home, it's unreal.) Maybe I should start taking photos of illegal tyres and sending them to GoSafe hehe

As for those that drive at 40mph in a 60, carry straight through the 30 limits in villages at 40, then flash and beep when you pass them at 60 when back on a NSL road... shootsmashfurious

looks a bit quick through the 40 signs, and I'm sure straightening out the bends wouldn't have gone down well.

I don't see it worth 6 points though, and for me, not DWDCA

The gosafe site mentions court due to not replying to FPN(?) probably the reason for such a hefty penalty

What about the fact they didn’t have a licence?

“ summoned to Court where they were given an increased fine of £640 and 6 penalty points for driving without due care and driving otherwise than in accordance with their license.”

Maybe worth a mention. Pathetic attempt at stirring. Daily Mail got jobs going?

OTOH it's a 30 limit and passing a junction. And then they ignored the FPN offer. I struggle to care TBH.

ETA I missed the no/wrong licence bit. I've moved from apathy to "good".

Was gonna say the same, and if the change in limit is to a 40 then it means that they completed that overtake in the 30.

The straightening out bit.. don’t the IAM still do, “if there’s no one about, straighten it out? “

Might have something to do with the way they cut the corner and barreled up to the bus.

It didn't look like a controlled overtake and looked careless in my opinion.

I don't think the visibility was great with the lorry and bus in front and they could've been hiding a motorbiker or cyclist coming the other way.

Straight lining is still taught provided you have proper line of sight and it won't effect any other road user.

Watched the video again and clearly well above the limit going up the hill in the 40, also overtook with a junction to the left and an upcoming junction on the right. That's what made it naughty.

Fact they ignored the FPN/Request for driver details and didn't have the correct licence is probably what took it up to 6 points and sizable fine.

Edit:- Actually watching it again, I'm not 100% that is a junction on the right, looks like a dirt road but not 100% if it joins the main carriageway or not.

Looks like it was more because he failed to respond to the original notice so they stitched him up. Mentions he passed the filming vehicle too.

I honestly didn't realise this meant they didn't actually have a licence. (Genuine question, not being smart: how can you "drive otherwise than in accordance with" something you don't have? confused )

Sorry, you lost me. If this is a reference to me, I fail to see what 'stirring' is going on. I'm actually hoping to learn from other people's responses (including serving police officers who post on here), because as per my OP, up until now I would not have said that was a DWDCA offence.

If they had no licence then they can go to hell, I have no time for such people. And if they also had bald tyres and shonky lights, they can go beyond hell hehe

Looks like a decent result, and DWDCA is definitely made out in my view (cop). The only 'scary' thing about it is the driver's incompetence, which is unsurprising in the circumstances.

Poorly executed overtake at excess speed in a village, accelerating in to a series of bends at what appears to be excess speed with no apparent consideration or planning for the slower traffic in front, which they then tailgate.

Initial overtake fine, leaving village very clearly, though above the limit. Broken white lines, two bends only (safely done), no visible tailgating. You're watching the clip in the OP? smile

But that's a fundamental issue which renders this thread pointless. The text says the camera car was overtaken, which happened before the clip that is posted. We don't have all the video so any criticism of the prosecution is pointless because we don't have all of the facts.
