Are parking eye fines enforceable?

That’s already gone to Debt collectors, DCBL are the lot you see on Can’t pay we’ll take it away. Prepare for a knock on the door if you ignore. wink

The advice use to be ignore it, I did many years ago and nothing ever came.

I believe the advice now is to not ignore it, there was a good website called peppipoo http://www.pepipoo.com/

completely wrong and unhelpful comment - there will be no knock on the door.

DCBL are hired by several parking managment organisations to try and bully the keepr / driver to pay. it seems you have missed the opportunity to appeal (though that would likely have been rejected anyway).

ignore this letter and any more letters from DCBL but DO NOT ignore a claim form from the court. if / when you recieve a court claim form visit the parking ticket forum on moneysaving expert and if you follow advice on there and use thier template responses its most likely you will not hve to pay anything.

Unfortunately, you shouldn’t just ignore it. You might get forgotten about in among the millions of charges they’ve issued on the same day as yours, but my experience is that you won’t.

Btw, my experience is that, even as an employee of the place where you’ve parked to go to work and have ‘registered your vehicle’ on three consecutive prior days, they’re like a rabid dog. They would suck the last breath from you and stand there smiling about it. How anyone can claim they have an ounce of morality and still do the job they do each day absolutely astounds me.

Reading the OP's letter it clearly states twice that 'The case is not subject to High court or bailiff action'.

Also says that if you do nothing then they will recommend that their client commences legal action against you.

Reads to me that it's just a letter asking for payment & there is no court judgement yet in effect that would allow action of the 'Can't pay we'll take it away' type.

dunno what that comment means but your previous post suggesting that the OP should expect a knock on the door was silly because that could only happen after the case had been before the court, the OP losing the case, a CCJ issued and then ignored. the letter the OP posted up was simply a 'request' for some money, has no legal basis whatsoever and can not in any way be a precursor to a knock on his door.

thus, your post - quoted above - was worse than useless.

Absolutely right. You will receive lots of letters threatening you with all manner of scare tactics. No one is going to knock on your door. If PE want to progress it they will have to issue court proceedings. Check out Pepipoo for advice.

In the (seemingly) unlikely event that they do take a motorist to court how much is the total bill liable to be?

There will be the original fine but costs will be added as well?

Parking Eye are one of the more litigious PPCs.

Let's say the fine is £120, County court fee is £35 for claims under £300, from what I've seen £80-£120 for solicitor fees, so c. £300. If it goes to Court and their solicitor attends Court it could mean another £100-£200 on top. That's IF they win.

few of these cases get to court. the tactics of parking companies is to issue ever increasingly threatening letters in the knowledge that many folk will simply pay up. they want you to believe that you are clearly liable, will lose in court, suffer hugely increased costs and bailiffs at the door etc. many folk do believe this and so pay up - it's the numbers game.

the fact is that if you respond in the correct manner the parking companies will usually stop chasing you. they actually have no desire to face you in court because their recoverable costs (if they won) are less than it costs them to process the paperwork and attend court so the court process is an uneconomic result for them, win or lose.

it's true that many of the cases which DO reach court are won by the parking companies but that's simply because the defendant didn't reply to official court correspondence and therefore lost by default or didn't turn up at the court. following the correct process will usually see them dropping the case (though the OP does not, as yet, actually have any claim to defend).

you can get more detailed advice on pepipoo or MSE but if you redact the personal details and post up on here the documents that you have received so far (Notice to Keeper) that would be a good start.

They take people to court not because an individual case is a financial win for them, but because they can use it to show how "legitimate" their charges are and frighten others into just paying up. Each court win = plenty of other intimidated punters.

Second, you were doing well with Pepipoo and MSE, until you suggested posting the information here too. All that will achieve is the usual sanctimonious pile-on telling OP that they were bang to rights. To the OP - Pepipoo and MSE are the only places you should use for advice.

It's true that Parking Eye are litigious and also certain that their agents will continue sending out fake demands for money to OP. however, they aren't stupid and won't proceed to lodge a court claim unless they expect to win in court and as they already have thousands of successful prosecutions under their belts, a few more wins won't make any difference to their future ability to threaten yet more folk.

it's worth OP posting up here the NTK before posting on MSE simply because it may not be pofa compliant in which case the thing could be dispensed with right away. additionally, its apparent that some folk on this forum could benefit from a greater understanding of the legal position on these matters and the thread is not a discussion about whether the OP should have parked there, for how long or whether he should have paid etc, it's simply about the enforceability of the PCN.
