See section 20 (15) - it seems to be after they agree to refund but they could insist they want to inspect before they refund. so in a way get it off you first.

They come, check I haven't put the windscreen through and such, pay me then take it away. Much like buying a car but in reverse.

This. In this day and age it couldn't be easier, they come and inspect the car, then phone back to base and get them to make a transfer to you, it should be in your bank within minutes and away they goOP out of interest if they have such a dodgy reputation, why on earth did you buy from them?
Their answer is still "take us to court", won't entertain a rejection at all. So now I'm enlisting solicitors. More of a waste of time and money for something they could very easily rectify. It's only a sale in reverse. Something I wouldnt expect is difficult on a sub £10k car.
The most unusual thing about their response is that it'll just cost them more in the long run. (unless they disappear completely, which I'm now dreading).

Do they disagree with your local garages opinion?
Did they agree to you getting it inspected independently?
It's odd that such a dealer you describe would simply say "take us to court"
OP the best thing you should do now is take it for an MOT to prove it's a failure a week after you've bought it.
Dealer could question your local garages diagnosis, will be more difficult for them to do that if you have an Mot fail from a different garage showing the emissions you describe.

Following consultation with my solicitors they've actually been naughtier than I first realised.
The matter is now in the hands of my bank's fraud department, trading standards and the police.
So I'll leave this thread cold for a while and update upon eventual resolution / non-resolution.
Could everyone please keep their fingers crossed for me?

Once it's back up, I'll be sure to include all legitimate facts related to the thread for everyone to see. Not the most clever thing to do during an ongoing legal issue though. Unfortunately, threads from Pistonheaders have turned up in court during an ongoing case previously.
