Does anyone think this is an acceptable panel gap between bonnet and wing or signs of previous panel damage? the other side looks spot on

Are there any signs that the bonnet has previously been taken off? Chips or marks on any of screws perhaps? It might have been taken off for a respray and just not put back on straight.

wing and bonnet have been painted at some stage its in a mercedes main dealer with a near 40k price tag. Would you remove a bonnet to spray it?

Bonnet looks high to me - the swage line doesn't line up properly. Might not indicate panel damage though - there's often a lot of adjustment in how it's bolted to the hinge, if it's been off it may just have not been re-fitted properly.

I've decided to return the car as for almost 40k I dont think it's good enough. replacement wing also has poor gap and protrudes painted the entire front end at different points in time. The list is quite long, but the panel gaps and paint swung it for me id never be happy with it

yes there are signs uts been removed and painted but I don't fancy messing about finding out etc I've decided to return the car to the Mercedes for a refund.
