Mrs N has received NIP for her (new to her) lease car.
Vehicle caught on average speed cameras on the day it was being delivered (approx an hour before she took delivery)

Car is not brand new, it is/was a 12 month old vehicle in the lease companies available pool.
They had it in storage and had arranged for it to be delivered on the 23/06.
Due to rail strike it was delivered on the 24/06.
Lease company have it logged as delivered on the 23/06
We have home CCTV showing delivery on 24/06
Mrs N has contacted the Lease company, who have said they will take it up with the distribution/delivery company, for her not to worry.
Lease company won't share name of distribution/delivery company.

Concerns are;
Lease company will do nothing and the responsibility lies with Mrs N.
She can't correctly complete section 172 as we don't have driver details, only the Lease company details.
Can section C (driver details) just be given as a company name?

Any advice, greatly appreciated.

Just return form saying she wasn't the driver and can't name the driver as it was before she acquired the vehicle.

I would be writing a letter to the ticket office, with a copy of the paperwork for the car showing the time.

You need the address of the firm as you need to provide details for them to write as you are the keeper and you have obligations under that, either than or send the lease company details but that is not ideal!


However them sorting it out internally is non starter! You have provide information, whats the transfer paperwork for the car say?

Your CCTV will show proof, return the NIP as not her driving and give the lease delivery company details with a cover note perhaps

Furthermore surely on handover there is a signed document stating when delivery was (24th) and a time?

Who holds the V5C?

Reason for question: If it is the lease company, then they have been around the loop once and already given Mrs N's details as the driver. Not necessarily a problem, but just a bit more to unravel.

this save that I would name the lease company on the form as the person who was driving/can identify the driver then the requirement to provide any information she has is met.

Apparently they nominated her as they had delivery logged as the 23rd, not the 24th.

Simply this ^^
It’s obviously crucial that you can establish date and time of receipt of the vehicle.

Looks unlikely that the lease co are the RK, not enough time for the NIP to go to them, back to plod and then on to Mrs N.
As others have said, reply with what Mrs N knows - not me, here's why. Then add what she can with reasonable diligence find out - the name of the lease company. They will get the next S172 to deal with.

Nothing to get worried about in my view

I'm pretty sure when I've received leased vehicles I have received a condition report by email shortly after delivery with the time and date on it.

In fact I just checked and I have 3 of them, all dated and timed.

To put a bit more meat on the bone, I had left this out to avoid the OP being too wordy, but perhaps is pertinent.

Mrs N's car is a company provided lease car.
Her old car should have gone back last year, but her employer is redoing their car policy to EV's and hybrids, so it got extended. Lease company came back recently saying they could do with disposing of the previous car and here is a list of pool cars she may want to choose from.
She choses a 12 month old car, and they delivered it on the 24th and BCA collected the old car a few days later.
As such, there was no new agreement, the only signing for was on the drivers phone/pda, which Mrs N is still chasing for the POD.

Thanks for all the input.
She has stapled a covering letter, and given the lease company as the name.

What you have done so far is all you need to do and should be fine. Whilst having some sort of document electronic or otherwise showing the delivery date would be helpful it is not a deal breaker by any means. Your wife’s obligation to answer the S172 is ‘as any other person “ and not as the keeper because at the time she wasn’t, so the requirements are set much lower, all she needs to do is to offer any information that is in her power to give which may help identify the driver which she has clearly done
Despite what you may hear she does not have to prove she had not taken delivery at the time of the offence, it would be up to a prosecution to prove that she had

Not necessary. All that is needed is to simply return the form stating that you only received the car on the 24th, with evidence and nominating the lease company as 'driver'. No need for photos of the driver or anything else.

Won't be on trade plates, the lease co will have an any driver policy ('cos continuous insurance requirement)

you do know trade plates are just vehicle excise duty for any car they have no meaning as far as insurance goes?

Possibly some overthinking going on here.

As a person other than keeper (which she was at the time of the alleged offence), the OP's partner is required only to provide any information which is in her power to give and which may lead to identification of the driver.

A simple letter attached to the s.172 notice explaining that the vehicle was not handed over to her (by XYZ Ltd) until the 24th should suffice.

That's it, no need to go all Hercule Poirot on this one..
