Bus Lane infringement is it enforceable?

For those of you that know it Caerphilly road Cardiff from the Dr Surgery past the Chinese takeaway. It’s a really like donkeys hind leg and weaves in and out a few times. Last night we went to collect a Chinese, the weather was atrocious with rain wet roads and glare from oncoming headlights making very difficult to see and follow the road markings.

My wife was driving at around 20mph and was complaint at the time she couldn't see the road markings very well. I could only agree from the passenger seat with little else to do but look for them. So now we are awaiting a ticket. The cameras can see very well in all conditions (I know I’ve had a ticket from the same camera - thankfully I proved it was the car behind hat went in the lane)

Can you still be held liable when visibility is so poor?

Like most other traffic offences, you should be able to get off simply by using the excuse that you can't see.

OK I admit my post was/is a bit dumb abbé if we do get a ticket we could plead mitigating circumstances but the offence is probably absolute.

Pleading mitigating circumstances for a minor motoring offence just isn’t worth wasting a few hours/days of your life for.

As well as the bus lane, is there a lane that you could’ve stayed in all the way instead of chopping and changing?

Also, if you got a ticket from that very camera then you know very well that the bus lane is there, so why did you not tell your wife as such?

Reminds me of people suggesting mitigation that their car is well maintained and has bigger brakes etc so the normal rules shouldn't really apply to them.

Perhaps the OP and his wife could use the poor visibility defence in all walks of their lives:

Drive into a bus lane - poor visibility.
Run over a child - poor visibility.
Stick your cock in someone else who isn't your wife - poor visibility.
