Assuming they are confirmed guilty of course.
I think I've captured most of the possible punishments in range of harshness from the other thread.

Strip of them of points, fine them massively and take away 90% of their wind tunnel and cfd time.

As for Horner, Wheatley and Marko, they should be all placed in the stocks so Toto can throw wet pumpernickel at them.

A points deduction for the year in question, from both championships - sorry Max
AND
A fine of several times the overspend, to be included in the current year cost cap - stop now on 2023 dev.
AND
Aero and wind tunnel development restrictions for next year - so they turn up next year with pretty much this year’s car.
AND
Suspended exclusion from championships, for five years - just to be clear that this is serious.

Well that seems a bit harsh, they didn't murder a dozen children...

But I think the punishment HAS to be very, very serious IF the overspend is over 1m. That is a massive amount of development money and I have little doubt Merc and Ferrari will be shouting from the rooftops. It is also money that impacts upon this year and next too.

Anything less than super serious and all the other teams can simply spend that much too.

Problem is, the rules specify a “minor” overspend and a “material” overspend.

By it’s nature therefore, the rules classify this infringement by Red Bull as ‘immaterial’

According to the rules therefore, it’s a minor punishment. This to me means perhaps a reduction in wind tunnel time, a fine, maybe a suspended points deduction.
Certainly, any talk of championships being taken away and so on is Jackanory.

Now, whether the rules are correct is another matter…..

I can not see anything else being acceptable. Otherwise we have a clear statement - break the rules, win the WDC and keep it. All that means is the other teams will spend 4.99% over and even if Merc/Ferrari did so to win the WDC next season, they will get to keep it.

And that overspend impacts upon this season too of course, that development has not vanished, but has been improved upon.

It does indeed give them the option. That’s a trap door in case someone invents something silly that is against the spirit of the rules and needs punishing hard.

There is also the option of a reprimand….

Point is, the rules identify this as “minor” therefore the punishment will be “minor”.
