I wasn’t sure whether to post this here or in the Homes & Gardens forum.

We move to our new build on Friday. Does anyone know if this clause would prevent us from buying and erecting a garden shed? We want a fairly big one say 10 x 5 feet.

In practical terms, no.

In reality if the sewer failed they might request you move the shed and they would dig through the shed base. Highly unlikely in any event.

I used to work in Building Control and people built extensions over sewers fairly regularly, often inadvertently. They were just required to enter into a building over agreement with the water company.

You do understand that the clause only applies to the area of the sewer easement?

Is there nowhere in the garden you could erect a shed that isn't affected by the easement?

I used to look after high pressure fuel mains around the country. Every landowner had a wayleave agreement in place. Generally we weren’t fussed about the likes of sheds,patios and other frangibles. The agreement was, if we had to go in for any maintenance, there would be no fee paid to replace it. The reality was, it almost never happened.

It does say that quite clearly in the clip you posted.
