I can’t quite work out why my friend still has a license.

He was caught doing 40 in a 30. Received 3 points and a fine plus court fees because he “forgot” about the letters until it went to the courts and he accepted the outcome.

He was then caught doing about 80 on the M1 in a 60 variable limit. He was given a speed awareness course which obviously he happily accepted.

He was again caught in a variable on the M3. He was given a speed awareness course.

He was caught doing 51 in a 30 by a mobile camera. He was given 3 points and a £100 fine. How was he given this for the speed he was doing? Plus it was round a bend not far from a school next to a park around 8-9 in the morning.

So he currently has only 6 points for 4 speed offences in the past couple of years.
My understanding is he should have only been offered the speed awareness course for the 40 in the 30 if he had actually returned the initial letter. But after that he should have received points for all offences and at least 4 for the 51 in a 30 is that right?

Was it admin errors that he was given the speed awareness courses? And why only 3 points for the 51 in 30 offence?

Plus before anyone says anything I do think he should have lost his license because I think as harsh as it sounds he needs a wake up call.

Do you actually know the details of the offence circs? Or just reported info? For example if the 80 wasn't in a 60 vble then it'd be fine for a SAC.

I know the 40 in a 30 circumstances and I know the 51 in the 30 circumstances as described, I don’t know the exact circumstances of the other two other than there was a variable speed on the M1 that was 60 and he didn’t notice and continued driving at 80 or there abouts (I don’t know the exact speed).
I don’t know the exact speed on the M3 offence either other than he said it was a variable again.
I was under the assumption that he wouldn’t have been offered a speed awareness course after the 40 in a 30 offence as he already had 3 points and the speed he was caught in the 51 in a 30 limit would have been over band C threshold?

Over band C threshold??

Band C Fine is applicable if court proceedings are commenced. I'm guessing that you've been on the internet and read a misleading article about "new speeding fines." Ignore nonsense articles on the internet. The authors of these articles generally don't understand the Fixed Penalty system in this country.

If a Fixed Penalty is paid then that avoids court proceedings.

The upper threshold for a FP is usually 49 mph and is independent of a Band C Fine. If he was offered a FP at 51 mph then he's quite lucky.

Sounds like your pal completed a NSAC, a MSAC, paid one Fixed Penalty and was prosecuted for one marginal speeding offence. Nothing particularly unusual about that.

I am aware that there are two types of courses:
Speed awareness course for speeding on a normal road
Motorway awareness course for infringing motorway variable speed limits etc.
I believe that the two types of courses don't cross over, so you can be sent on both.
That could explain 1,2 and 4, but not 3, unless there is no limit on the number of MACs you can go on in a set time period.

Can I have a Motorway Awareness Course if I have Attended a Speed Awareness Course?
Firstly, the matter of a course offer rests entirely with the Police.

And yes, the National Motorway Awareness Course may be offered to those caught exceeding the posted speed limit on a motorway where variable speed limits are in operation and any such offer of a course is not affected by attendance on a Speed Awareness Course.

I wasn’t aware there was differing courses regarding the motorway and speed awareness course, that explains it, thanks for the reply smile

80 in a 60 wont be speed awareness. It would be points at that speed. 75mph is the limit for a course.

51 in a 30 is court.

Few things that don't add up. I would suggest that he isn't being honest or has got confused.
