Odd. Completely clean license, never been pulled over or done for any kind of traffic offence.

Was pulled over in July for speeding. Officer alleged 72 in a 40 on a dual carriageway although would've sworn I wasn't going that fast. No paperwork given, no evidence shown but given what I assume was a verbal NIP.

Today, receive a conditional offer. 3 points and £100 fine, 28 days to accept. Again no evidence offered, warning in the letter that if I decline may be referred for prosecution.

Thoughts.

Am I just lucky that if I was really going that fast I got someone in the MET on a good day who decided to let me off with a relatively light sentence?

OR

Do they not have evidence? Bit of a gamble I appreciate if I go that route.

The only two options are to comply with the conditional offer or request a court hearing.

I’d imagine there would be some evidence to back up the claim of 72 so a court hearing could run the risk of higher fine/points.

It just seems odd. I feel like if I was actually doing 72 in a 40 they'd throw the book at me regardless of clean license no?

How fast do you think you were going? Unless you were doing less than 40 I'd rip their arm off.

In all honesty I don't know. The officer said they were following me for miles but it was rush hour and it would've been constrained by the weight of traffic. Certainly possible I was over 40 but again, I can't believe it was 72.

I suppose given that's the case 3 points would be fair. Still makes me wonder though, no evidence and driving a red Ferrari, was it vindictive? Officer did make mention of "I'm not just some *expletive* out to get a Ferrari".

On the vindictive side. Only today my mate John (retired) said he had just attended a speed awareness course 1mph over 30.
The course teacher said "you can always tell by the sound of the engine if you are going too fast"
Which John promptly replied "Not in a Rolls Royce" - albeit his is 40 years old.

I'd still probably take the FPN and chalk it up to experience, a bad one but still. You're not likely to win 1st time round in court, how far do you want to take it? How much do you want to spend?? £££weeping

A customer once told me of a Leicester Police had a 'No Tolerance' speed awareness approach one Christmas! He got done at 32 in a 30mph! He wasn't happy. Then again, he was a bullstter!

Thanks for the feedback guys.

Yes, does seem unlikely they were following me for that long in rush hour traffic but given the risk I think I'll just accept the conditional offer and take my licks. In general I consider myself a sensible driver (don't we all?!) and am not blasting around roads like a madman. I'm sure sometimes I creep over the limit but it's by single digit miles per hour, not tens. That much said, I don't know how long they were following me for and if I was under the entire time so may as well just take the hit.

I've heard of a couple of people getting speed awareness courses for 1 or 2 mph over. Seems to be certain police forces. Maybe they're not getting enough real speeders while petrol is so expensive and there's punitive terms in the contracts with the SAC providers.

I think I would refer people to previous replies on this subject. Until we see a definitive copy of a NIP for 1 or 2 mph over the limit, I would treat stories like this with a pinch of salt

I doubt it, we are still all waiting to see the legendry 31mph speeding ticket!!

Who talked about it ? The attendees or the presenters - Did anyone show proof that this was the case ?

If its anything like my force, the officer will complete the TOR (either paper version or on a phone/tablet). It will then go to the central ticket office. They'll review the evidence they have received (back of the ticket that the officer has will have a statement section). If the ticket office believe there is enough evidence they'll process it as per the guidelines for speeding (I think 53 and below in a 40 is a course, up to 65 is a ticket and 66+ is court).

They wont just be chancing it as its a waste of everyones time.

If you want to see the evidence, you'll need to select court. FYIW they don't have to prove you were doing X speed. Just that you were going above the speed limit.
