Unfair -HMRC now owe me

I sold some property in 2021 and was late filing the return within 30 days at the time.( 1.4.21- 4.6.21. ). I was then clobbered by a large penalty notice of several thousand pounds. Wasn’t happy but there you go…
My year end accounts were then submitted for the period April 21- April 22 , during this period I had sold some shares and made a loss.
My accountant has now applied for a tax refund . This has been going on for months now. Last week he rang HMRC and told them he was going to make a formal complaint as he had applied 3 times for the refund and heard nothing.
Today I received a refund of income tax … The capital gains part is still owing…. I’m fuming that I had to pay the penalty charges initially, and here we are with them owing me money .
