Hi all
I've been sent a NIP for doing 49 in a 40 on a duel carriage way,
I recall when the camera went off and it was just as someone undertook me past the camera so i wasn't sure if it was me or him that got flashed.
do you think i can argue this at all?
Any help appreciated
cheers

Were you in fact doing 49mph?
So you weren't going more than 40?
Can you redact the personal data and upload the ticket
The sensor loops as I understand can differentiate between lane 1/2/3 etc.
There should be two photos and the measurement markings so they can check the speed.
It may well be he was 52 and you were 49 for example and you both get ticketed.

What do the photos look like, you should have been sent them.
Also, top tip, for a temporary speed restriction, check that there was a valid "statutory instrument" in place with the correct dates. Email to the national archives is what I did, they were very helpful, I won my case, an excerpt from my thread in 2014:

Should be able to check here:

Assuming we're talking about a Gatso camera here, the images can simply be reviewed by a human to determine which vehicle actually triggered the flash by counting the lines on the road between the two images, which is the secondary method of speed measurement (the primary being simply the radar measurement). Each line represents 5mph, so it takes just some basic maths by a human to calculate the captured vehicle's speed with no dispute.
If another vehicle appears in the same pictures in an adjacent lane, this secondary method is a way to determine which car triggered the flash.
Go on, redact the letter as much as you want and post it...
