If you get a parking ticket, challenge it (which is rejected) and then pay the reduced amount to stop costs doubling which I would struggle to pay
If subsequently it comes to light the reasons for declining the appeal are proved to be untrue is there anyway to challenge this and recover my money?
I got a parking ticket for parking my EV in an EV only parking bay for 'parking without charging during prescribed hours'.
I wasn't charging because the councils signage attached to the post stated the post and those in the area had been retired. There was no signage to say vehicles had to be on charge OR in the case of the post being retired so no EV vehicle could charge being suspended for all vehicles during the hours specified.
My appeal was rejected as quote "they had 'thoroughly investigated and confirm the chargers were not retired and operational" Their signage showing the council logo indicates otherwise and a call to BP confirms the date the posts were taken out of service being before my PCN.
If the charger was working I would have been charging as I have done when I have used the post in the past. If the bay had been marked as suspended I would have parked in another bay and paid, some of the EV bays in MK like the one I was in are free for EV cars which seemingly have to be charging which makes sense but is not on their signage.

I got a ticket for parking in a car park with a yellow outlined space rather than white outline space. I'd bought a ticket & hadn't noticed there were two differing colours.
I paid the fine to get the reduced amount. I then put my appeal in, was successful & was refunded.
So, I'm guessing the answer to your question is yes.

Yes but my point is the fine was for not charging in an EV bay that nobody could charge in because the post had been switched off. The bays are free to park in (whilst charging it would seem although this is not on the signage). If you can't charge in it then there needs to be signage stating parking is suspended during the period you could be finedYou don’t need the special space if not charging I would state.

Some of the EV bays in MK are free so you can park all day without paying the parking charges but it appears you need to be charging. In the past I always have because the chargers were working. Ironically it cost more to charge per hour now than it would to park in the pay bays at £2.50/hr
The bays aren't marked up so you can't even pay to use the space as there is no indication of what the fee would be as this is based on location. Bays cost anything between zero and £2.50/hr

Agreed but back to my original point and issue with the PCN, there is no charger to charge on and no signage to indicate the bay is no longer free or what the cost per hour would be so parking there should be suspended until such time as the bay markings and signs are updated. The council declined my appeal stating the chargers WERE available to use. Their own signage says not and BP the post provider confirm the chargers were deactivated at the end of Dec 22 when you speak to Customer service......
Where (exactly) was it?
If it's in an area of "red" bays then they probably have a point as you didn't pay for red zone parking.
If it's in an area that's otherwise free (e.g. by the theatre/post office) then worth fighting further.
I parked in one of these the other day (in an ICE) as the charger was retired. Didn't get a ticket but may just have been luck!
The signs can be a bit ambiguous:

Opposite M&S on Silbury Boulevard. As you rightly indicate, some of the EV bays like those opposite Virgin Money & M&S are marked out as Red £2.50/hr bays, the 2 points round the corner from where I parked are purple charged at £0.50/hr. This is in addition to your charging costs. All the posts in this area have been decommissioned. The EV signage is as you post but it is now defective as no vehicle can charge in any EV bay

No, I would have assumed the colour on the floor in front of the bay was payable regardless of it being an EV bay or not. Only the bays with no markings on are free which are some distance from the shopping centre and a handful of the EV baysGranpaB said:

I have nowOn my initial appeal I detailed in the narrative the charge points were decommissioned but didn't send the picture of the signage. I assumed maybe foolishly, when they investigate they do a proper job and check a persons claim. The signs also say bp in partnership with MK council so you would expect the parking people know what is going on in their car parks?

Is it council or private?
Do you have a photo of the signage, is charging a condition of parking in these bays, as you state if charging was not working, I have seen people in office pug in away so it looks like they tried, maybe that would have saved you the hassle.

Yep, not charging whilst parked in an EV bay. Thing is the chargers have been retired so you can’t charge.Checked my ipad! Bingo

No signage to say parking bay is suspended.
How can they issue a valid ticket for not charging when you can’t charge?
The long-term solution to this type of problem is of course an annual "Purge" style event, where politicians, council officials and similar parasites can be ritually hunted down and publicly humiliated by anyone who's up to date on their car tax and Netflix subscription.
It's the only way they'll remember that they're there to serve us, and not the other way around
