Morning Pistonheaders !

I am looking for advice on the chances of success or peoples experiences of applying to the magistrates court to reduce your driving ban if you have had a ban of 3 years and have passed the 2 year initial period before you can apply. I have 8 months to go before my disqualification is due to end, but I have had a significant change in circumstances surrounding my elderly parents who live 360 miles away from me and are currently cared for by my sister. Her health has started to fail and thus my parents would be dependent on me to take care of them, ferry them to hospital appointments etc they have little money and can't afford taxi's etc. they are 75 and 82 respectively. I have been advised that this would not be a significant material change to get the JP here in Bodmin to look favourably on my request. Has anyone been through this process and succeeded.

3 year ban, that is significant!!! You must have done some very wrong or a serious of driving bans.


Also drink driving effects it, they do sometimes offer medical testing and doctors report to reduce the ban by 3 months I believe. Basically the testing shows your not abusing alcohol based on blood tests.


As far as understand your change in circumstances is not grounds, but you may need formal legal advice, have you sought that?

To get a ban reconsidered you must have a good reason for asking for the disqualification to be reduced. For example, if you think the court made a legal mistake or there were reasons you committed the driving offence that the court did not take into account.

Your right if its under 4 years and more than 2 years has past, that bit is right for reconsideration.

Since its 8 months and courts are bust might be worth just waiting.
