Dodgy insurance company?
Discussion
I had an accident in my daughter's car i was driving doc (my insurance her car).
I was on a dual carriageway and was undertaken then the car slammed the breaks on an guess what i could not react in time.
Anyway I contacted my insurance who told me to contact her insurance and gave me the details of the company to contact.
Her insurance inturn contacted her and she didn't reply in there time frame and they found in my favour and offered to pay my daughter out for her car as it was a total write-off.
Then when the payment didn't go through on the day they said i contacted them again.
Now they were saying that she was denying responsibility, thats fine but she isn't putting in a claim.
So now im in a position where my insurance has closed the case as it was found in my favour and her insurance is saying unless she put in a claim (any time up to 5 years) there not doing anything.
I feel like ive been done here..... It really seems like they have shafted me.
Any help/advice would be very greatfull.
I haven't posted the company name due to it may be against forum policy.

None of the above makes sense.I was on a dual carriageway and was undertaken then the car slammed the breaks on an guess what i could not react in time.

You were driving the car DOC under your own insurance, so why are her insurance company involved, there is no way they would be paying out even if things were found in your favour, surely the 3rd parties insurers should be paying out ?
Just go back to your insurer as they are the ones on the hook for the claim, not your daughters insurer, also check that you DOC doesn't exclude driving family members cars as some do.
Your daughters insurance won't be paying anyone, no one has been shafted, they aren't on the hook.
Good luck getting it sorted.
Thank you for the reply. I mean the womans insurance have refused to pay out and have said that they wont do anything because she (the other party) hasn't made a claim and only denies responsibility for the accident. (Surly she would want her car fixed if she isn't at fault?). My insurance have said because the claim was found in my favour they can't re-open the claim again and send anything to her insurance. My daughter's insurance are not involved as they were not insuring any of the drivers. Sorry for any confusion.
This is your insurers issue so you need to go back to them, they cannot find in your favour without the 3rd parties agreement, they may agree that you are not at fault but the 3rd party have not.
Their policyholder is denying an accident even happened so what proof do you have that it did ? pictures, witnesses etc ?
Driving DOC means that you are covered Third Party Only so your insurers aren't on the hook for your daughters damage.
You have 2 options:
1. Force your insurer to reopen the case, did you take Legal Cover with your policy, it can be used here ?
2. Provide all the evidence you have to the 3rd parties insurance company and get them to open a claim, again if you have legal cover that can help here.

My insurance have said they wont re-open the case because the other parties insurance have closed in my favour im not sure how it works because i have not received the payment but received all the paperwork.
I have spoken to my insurance about my legal cover and because i was driving doc im only 3rd party and that doesn't cover me for that car.
After the accident i took photos and provided the other partys insurance company with all the photos she has not said that she wasn't involved i dont think but said she wasn't at fault i believe but im not sure as her insurance company wont even give me details of what she said as they said its data protection. I wasn't even allowed her name. At the sceen of the accident she showed me her insurance on her phone which i took a picture of and i took a picture of both cars damage. Then she rushed off.
As you are only covered for TPO as you were driving on your DOC extension, once your insurers are happy that the other party isn't claiming from you, they will close the case. It's not for them to get any money from the responsible third party, they are only covering you for damage you do to other people, not for damage done by other people to you.
The third party's insurers would pay your daughter if they thought their client was at fault, but the third party doesn't want to involve them and hasn't reported the claim.
I say again, you have tpo cover and you've had a non fault claim, so it's entirely on you to get your claim settled. You need to issue a Small claims court summons (if the claim is within the limits, £10K now I think) and sue the tp personally. If she loses, she'll have to pay you or get her insurers involved.

Can i take her insurance company to court or get a solicitor to get her name from the company as im unable to get her name and address. I know its my own fault as at the time of the accident i didn't get it and her insurance company wont give it me due to data protection. Thanks for the help

Bit late now, but DOC is a can of worms. It's pretty wide ranging with some companies but others have all sorts of restrictions. It can disappear off policies from one year to the next so you have to be careful to chack it's still there.Apparently its original intention was to allow people to move cars if they were blocked in - it was never meant to be used for driving around.
For a daughter's car, it might even reduce the premium if Dad was added as a named driver. Both wife and I are named on our kids cars, and they're named on hers.

Take the driver to court, not the insurance company. Gassing Station | General Gassing | Top of Page | What's New | My Stuff
