Parking Eye again

My sister had to take her husband into Sunderland Royal Hospital over a minor matter which was quickly sorted out,it was late evening new years eve just gone.On leaving the hospital in the early hours of new years day they went to the car park payment machine to pay fee only to find the machine switched off and a notice saying there were no parking charges for new years day,there was also a similar notice in the hospital reception area.
As you might guess she has received a parking charge notice from those w@nkers at parking eye,to which she has promptly appealed.
Ive told her that if they deny the appeal then just dont pay and let them take her to court,as they dont have a leg to stand on.
How do you see it going?

It rather depends what she's put in her appeal. Most likely they won't drop it, especially if she doesn't have any evidence. And if she's identified herself as the driver she might have shot herself in the foot somewhat.

The answer with Parking Eye - or any other private parking charge - is that what happened is usually irrelevant to how easy it is to defend the charge.

I hope she has evidence of the signs, otherwise she'll be the one without a leg to stand on. There are other points at which you can get it cancelled before court so don't let it get that far. If there's no evidence already then get in touch with the hospital ASAP to see if they'll confirm that the parking charge should not have been issued.

If it ends up in court then being aware of the drivers identity doesnt strengthen the parking companys case that their terms and conditions were violated,and iam well aware that whatever a defendant says in their appeal against the parking penalty nearly always falls on deaf ears.
But it would be for a judge to decide the outcome not parking eye,and common sense should prevail.
There would have presumably been other people using the car park between late evening dec 31st and the early hours of jan 1st.
I have told my sister to contact the hospital about this issue.

I used the search facility on this forum but it returned scores of threads about parking eye,and i cant be arsed to view all of them to see if anyone has appealed one of their parking charge notices on the same grounds as i described in my original post.

I would expect they will reply and say, yes sent in error thanks.

Parking eye have charged me twice in error and never had any issue having it cancelled.

Hopefully it will get sorted, these things are a pain.

I would have sent Parking Eye an invoice for having to spend time sorting out their st.

These tossers at Parking eye are just trying it on and they must be hoping that they are dealing with ignorant people,who will easily cave in and pay the pcn LOL,
They denied the appeal on the grounds that my sister didnt provide any evidence that parking was free on Jan 1st.
What evidence do they need when they will (or should) have been given prior notice from the car park owner that there were to be no parking charges for Jan 1st? Nor was there any notice of how to pay for parking for either side midnight Dec 31st. when the payment machine was turned off
There must have been other vehicles parked there at the same time so you would think that many other people have appealed their pcn's for the same reason,and that parking eye are aware of the problem and therefore cancel the pcn's.
But no....they are just simply letting it run in the hope they can bag a few hundred ££££s and then just quietly walk away grinning all the way to the bank.
Sister will be calling hospital today so hopefully all should be sorted soon

Go onto the parking forum on MoneySaving Expert or Pepipoo.

The new way to appeal these cretinous invoices is to appeal as the registered keeper and NEVER as the registered driver.

You appeal as the RK, they reject your appeal and supply you with a POPLA code, appeal via POPLA and PE will most probably withdraw and it will cost them £25.

Remember: Never identify the driver. Appeal as the RK.
