How screwed would the driver be?

Not looking for the holier than thou brigade, the driver is very aware & disappointed in themselves, a genuine mistake in temp. speed restrictions.

Guess it’s a court date?

3 points and £100 as far as I understand. Too much for a course but still inside the FPN window

I got caught at the same speed at the end of lockdown.

£100 & 3 points, no offer of a SAC

Assuming less than nine points already, you’ll get an offer of £100 and three points by a fixed penalty.

More than nine points and it’s off to court.

Agtlaw will be along shortly, hopefully.

Has the driver been sent any documentation such as a Section 172 notice (identify driver please) / NIP yet?
It matters if the car is not driven by the registered keeper on the V5 in terms of timeline.

I think the limit for speed awareness course in a 30 limit would be around 42mph per NPCC, but that's just from reading potential bks on the interweb.

Thanks for the replies.

Driver has a clean license, S172 has been received & driver is named on V5.

42mph is correct. 43 and above is FPN.

No. Fixed penalty.

Ignore nonsense on the internet about fines based on income.

Given my infraction was the first points I’ve received, I’ve often wondered if I receive a FPN which does comply with the offer of a SAC, would I qualify for one?

I have previously attended a SAC but beyond the 3 year time limit.

Yep as long as you are under the threshold (10%+9 I think) and haven’t done one in three years previously you can do another. Doesn’t matter if you have zero points or 11.

Might make a difference if you have 12 and been allowed to keep your licence.

I was caught doing 44 in a 30.
No prior points and was fined £100 and 3 points.

Same as me for doing 36 in a 30.....as I had done an SAC for 57 in a 50 within the last 3 years.
I must stop all this dangerous speeding.

I think fines for some motoring offences are based on income though? I recently read that Joelinton (Newcastle United Player) was done for drink driving and fined £29,000 - a weeks income presumably.

Only if you refuse the fixed penalty offer and go to court.

A fixed penalty isn't available for drink driving and that's a fine imposed by a magistrates' court.

A fixed penalty is fixed. The clue is in the name.
