No prison for man who raped 13 year old girl
Discussion
The judge says at 21 he is "too young" for prison, and doesn't believe prison will help in his rehabilitation.
How will a bit of community service deter him from offending again.
I seriously hope this gets appealed as unduly lenient.
I can't imagine how let down the victim feels.

Blame the SNP, it's their policy, under 25 you don't yet have the maturity to know what you are doing, but they want to give 16 year olds the

The old adage his brain wasn't fully developed so he didn't know you're not supposed to go around raping kids. right to vote. https://www.bbc.co.uk/news/uk-scotland-51657466

As MoP stated above - old enough to vote for a party that states he's not old enough to know his mind when committing crime. Between that and male rapists claiming to change gender while awaiting trial so that they can be housed in female prisons.Welcome to SNP Scotland!

A question (and does not justify)
Was it judged as statutory rape ? or full on attack, non consensual rape ?
The scenario of boyfriend and girlfriend having sex but it being statutory rape due to the age is a frequent one and often results in 'lenient' sentences if an actual charge is ever brought.
Right or wrong is up for debate, but it happens.

Horrendous, attacked on multiple occasions. Whomever set the sentence is clearly a rapist sympathiser.
I can't imagine what the poor girl had to go through not just in the attacks, but through the "justice" system and finally spat out the other side as some sort of community paint job equivalent. Awful.

That is a shocking sentence.
I would argue that in this day and age, even 13 year olds have enough information and know how to understand what is right and wrong. They are not children at 13 - sure, their brains may not be fully developed, but they should understand right from wrong in extreme crimes such as rape and murder.

Not suggesting things are ok for a second, but I do know from stories the wife shares (frontline child protection social worker) what happens.

My 13 year old is acutely aware of right and wrong, and has been for a very long time. My 11 year old is too, in fairness.I would argue that in this day and age, even 13 year olds have enough information and know how to understand what is right and wrong. I learned recently that the criminal age of responsibility has lowered from 11 to 10yrs old in England and Wales. Was surprised by that tbh, but ok. Though quite why Scotland sees 25 as the age of full responsibility i'll not understand, bonkers.

They say "Fury as man, 21, who raped 13-year-old in park walks free"
He's 21 now but the headline reads as if he was 21 years old when he committed the crime, rather than 17.
It's clickbaity.
This is as a direct result of SNP/Green Scottish Goverment policy which was implemented at the start of the year -
“A new sentencing guideline which make rehabilitation rather than punishment a primary consideration when sentencing young offenders has come into force.
Last year the the Scottish Sentencing Council recommended an "individualistic approach" for under 25s which takes into account their life experiences.
It argued that the proposed changes would help reduce reoffending.
The council said its decision was based on scientific evidence that the brain is not fully developed below that age.”

The four year timeframe seems very odd.
Little bit more detail on the BBC: https://www.bbc.co.uk/news/uk-scotland-edinburgh-e...
Apparently an appeal against conviction is planned - which sounds a bit risky.

I’m not sure it does; he will be appealing the conviction not the sentence, so if the appeal is refused the original sentence stands. That said, a probable outcome will be that the Crown Office will appeal the sentence.Gassing Station | News, Politics & Economics | Top of Page | What's New | My Stuff
