Morning folks.

Just prior to xmas I was in an accident. I was stationary at a pedestrian crossing and was hit from behind by someone not paying attention.

I suffered the expected neck, back, shoulder and chest pains you would associate with someone hitting me from behind at an estimated 20/30mph.

This all happened 200 metres from home so I managed to drive my car home and it was subsequently repaired at her insurance companies expense early in the new year.

From a physical point of view I am still really struggling, especially with my lower back. Due to the timing of the accident just before xmas I did not instigate any kind of personal injury claim at the time but I am now considering doing so as I am about to undertake physio on my back and I have been recommended to do a 12 week course that will cost me over £600.

Having looked online at Personal Injury Lawers and claims Management companies it is an obvious minefield. Can anyone recommend a Solicitor/Company who could handle the claim without ripping me off or causing me more grief. Also, does anyone have experience of the new Motor Accident Solicitors Society via the .gov.uk website?

I made the Huge mistake of engaging a so called “ Specialist We Are On Your Side “ no win no fee Biker Solicitors “ back in 2010. What an utter nightmare they turned out to be.

They'll rip you off, that's their business model.

Only you can decide if the 53% you get is worth the aggro

Your insurance company are there for insured losses. They may be able to put you in touch with a firm they have on their panel, but for small claims up to 5k you can do it yourself:

You can be represented using the above but you'll pay for that via any payout.

If your symptoms are long-standing or complicated or you have eventual losses higher than the threshold, the OIC wouldn't be appropriate.

Have you got legal cover with your car insurance? This is what it's for. Hopefully you will have seen a Dr but sounds like you should do so again as it's still an issue.

You should also keep a diary, not only of your symptoms (grade the pain 1 - 10) and what painkillers you're taking, but also how it affects your daily life, eg lost sleep, struggled with shopping, and any losses or extra costs you've incurred.

And when the other side's insurers start pressing you to settle for £x, just remember this.

My 18 year old daughter was driving 4 weeks after passing her test, and was hit by another young driver. The accident was on a bend, the other driver was completely at fault. My daughter's shoulder was dislocated in the accident. After a few weeks my daughter was offered £7000 compensation by the other girl's insurers and she took it.

Moving on, her mother took her to our local hospital last month for an MRI scan on her shoulder, as it was dislocated again. My daughter is now 36. We have spent more hours in hospitals and taking her to specialists in the last 18 years than we care to remember. She has spent many days in bed dealing with the pain, and more recently has carried on working with her shoulder out of joint so as not to lose her job.

So never settle until you are totally certain you are fixed.
