variable speed limit - speeding fine

I was driving at 60-70mph on the M25 at 4am on an empty 4 lane carriageway. I've been sent a speeding ticket on the basis that I entered a 50mph variable speed limit.
I was in lane 3 and went under a gantry which had diagonal right arrows to indicate to move to lane 4 above lanes 1, 2 and 3. Above lane 4 was a 50mph limit. There were roadworks approx a mile ahead.
Is there any possibility that I could get out of this, or should I just pay up and take the 3 points?

The possibility of getting out of it involves pleading not guilty and having to go to court to make your case alone or with a solicitor. Are you prepared to try that? And no I don't think it gets you off although it'll make a fun debating point here I suspect. Will it be 3 points or a SAC (at 10%+9)?

Signs indicating to be in lane 4. OP was in lane 3. Obv a camera isn't going to do him for DWDC but if there was a patrol car behind him he could very well have been pulled for a chat/attitude test.

Rubbish, the arrows are there to indicate to move across to another lane which the OP did, once the lane is closed it will be enforced by a Red Cross, the OP had committed no other offence except exceeding the speed limit in the open lane
