My dad has just went to withdraw money for he's holiday and it turns out he's licence expired back in 2021. Obviously he's really shocked and it was just a total oversight. My question is, now he's applied for a renewal can he legally drive in the meantime or does he have to wait for it come through? I've looked online etc but I'm not sure on the answer.
Presumably, you mean the photo has expired. If you mean he is over 70 then yes it has expired, not sure what you do then.
The licence is still valid (still legal to drive) if it's just the photo but with an expired photo date on it, he may have problems using it as id or for hiring a car. It lasts 10 years unless he's over a certain age (70 ish?) where it may be less.

When I had a total loss accident last year, I had to enter my licence details and get some kind of reference number from DVLA site to submit to my insurers as part of the claim. I assumed that meant that if I didn't have a licence that was still in date I'd have a problem with my claim.
Ok so I've just been to his, turns out he did receive a reminder but I can see how he missed it. He's only 59 but has his heavy goods which he no longer uses. The form looks like it's simply to renew his class 1 but if he'd read it properly you have to fill in a certain section to renew the photocard even if you're not carrying on the heavy goods part. So he's photocard expired in 2021, he's lucky because apparently if it passes 2 years he needs to re sit his test. I tried to renew it online but he's not eligible because of the heavy goods i assume. So I'll take him to post office tomorrow. He's going to Greece next week and was going to be renting a car but that's no longer an option unfortunately.

Nope. If you look on your insurance certificate, where it says person or persons entitled to drive, it'll say who the drivers are under the policy, followed by wording similar to "providing the person holds a licence (and here's the key bit) or has held a licence and is not disqualified from holding one.That last bit is to cover you if your licence has expired but there's nothing stopping you from getting a new one.

Summons received and I sent the Traffic Office the details of his new licence and copy of the Policy with the relevant parts highlighted. They were adamant - No valid Licence = No Insurance. I appeared with my Dad before the Magistrates and I had 3 copies of the Policy with the "providing the person holds a licence (and here's the key bit) or has held a licence and is not disqualified from holding one. highlighted.
The key point was he HAD held a licence (just forgotten to renew it), and was NOT disqualified from holding one (as evidenced by the same day renewal). Case dismissed and some grumpy Magistrates looking at the gormless "Police Prosecutor" on their Video Link.

OP if he gets caught its a £50 fine with zero points. Soon as he applies he can drive under section 88 until he has his licence back with him. Normally pretty quickly to be fair if done online.
Thanks for the help. It turned out it wasn't as bad as we thought, his car licence etc doesn't expire until he turns 70. It was his heavy goods that had expired so the photocard needs to be renewed still but he's still fine to drive.
