Worth fighting 3 points for Variable Speed Limit offence?
Discussion
I'm already on 6 points and still got another 2 years to run. Being on 9 points for 2 years is not going to be much fun, I'm buggered without my car.
I'm positive that the Smart Motorway Speed Limit caught me out at the last minute as it went from 70 down 50 miles per hour. I was clocked at 58 mph.
I was wondering if it's worth getting a Freedom of Information request to find out when that particular camera was last serviced/calibrated and then taking it to magistrates court and chance my luck?
Or should I just take the 3 points (I'm not bothered about the £100 fine) and be extra careful for the next 2 years and hope I don't get another and therefore a possible totting up ban.
The other option is contacting Nick Freeman aka Mr. Loophole's firm of solicitors in Manchester and seeing how much they charge.
Has anyone ever taken this to magistrate's court and ended up with a positive result?

All the brakist accounts will spew their usual bulls
t about rolling over and then getting buggared being the best option but ignore them, always worth fighting rather than rolling over, but most accounts on here prefer to leave their car keys by their front doors along with a note to say take them to whoever’s passing, and please don’t hurt me. Sheep & sharks really, but many people have challenged tickets and won. The usual brakist response will now demand I quote cases, well Google is your friend there, several high profile ones out there to research. Personally I particularly enjoyed the Hamiltons’ or Beckham’s.
Freeman definitely an investment.

Interested in particular in the always worth fighting point. That’s definitely not good advice if you mean in general rather than this situation.

Why did you bother joining PH if you've got such a low opinion of most people on here?

That reads like Vogon poetry.

There should be a lag between the limit changing on the gantry and speed limit kicking in.
The idea that you can be done by a limit that changes as you pass under it is wrong.
You can try obviously but that defence won’t fly.
60 seconds, I believe. At least according to the chap that ran the SAC I did 6 years ago.The idea that you can be done by a limit that changes as you pass under it is wrong.

I don't think there's much calibration involved.I'm positive that the Smart Motorway Speed Limit caught me out at the last minute as it went from 70 down 50 miles per hour. I was clocked at 58 mph.

Isn't what you want to know the time of your passing the camera vs the time the limit was changed?
I'd presume they have records of that?

Unless there has been some sort of procedural error such as the NIP arriving late, there would seem to be nothing in your account that amounts to any sort of defence that will stand up in a court. Ignore the frivolous comment by Ohio, it's not his money you would be spending, Going with a NG plea and losing will leave you with not much change from a grand. The speed in question is well inside the guidelines for a course if you are eligible I'm positive that the Smart Motorway Speed Limit caught me out at the last minute as it went from 70 down 50 miles per hour. I also got caught; it was 60 for at least 4 signs and then went down to 50mph where I was caught, just didn’t see it as it was heavy traffic with reduced lanes and I was trying to concertante
Went on the speed course (it was different to a normal speed awareness course) which let me do even though I only did a speed awareness course about 2 years ago
The instructor basicly said you can ask for the calibration but it will almost certainly have been done; on mine there was portal where you could view the certificate
Everyone on the course said the same thing, the speed changed between 2 gantry’s and the repsonce you’re not paying good enough attention to not see a speed limit change
He said that there’s a delay between the sign changing and speed camera changing
So basically you’re not getting away with it

Even the automatic road sign recognition in a Honda I used to have found it difficult to differentiate between the 50 and 60 signs as the font on the gantries is similar.
Made it pointless, as I had to manually check at each sign.
They really should flash the signs when a speed limit changes to make it obvious... if they were wanting to do that.

I’m cynical, the calibration has always been done on the same way Putin always tells the truth Went on the speed course (it was different to a normal speed awareness course) which let me do even though I only did a speed awareness course about 2 years ago

What!!! you actually had to check the signs rather than rely on the automation in your car which can be frequently iffy, absolutely shocking.Made it pointless, as I had to manually check at each sign.

The signs do not just change form one speed to another, they go off for a second or so before displaying the new speed, it's very obvious when you see it, it's somewhat irrelevant anyway, as said earlier, there is a considerable delay between the signs changing and the cameras becoming active at the lower speed. The traffic would have covered a mile or so between the 2 events

We were all supposed to be driving round in speed limited cars by now, but not much chance of that when they can't even read a road sign reliably yet. Mine would also fail to read the national limit entering motorways regularly, so would continue at 40mph.
Road angel I believe has a device that somehow knows what the gantries are displaying and can warn you in advance if the car has missed the change but it's not really mainstream.

They use a combination of an on board camera reading the posted speed limit and the GPS coordinates which have the speed limit for that exact location.Mine would also fail to read the national limit entering motorways regularly, so would continue at 40mph.
